Գնդապետը պահանջել և ստացել է առանձնապես խոշոր չափի կաշառք
SOCIETYՀՀ քննչական կոմիտեի ԶՔԳՎ ՀԿԳ քննության վարչությունում քննվող քրեական գործով մեղադրանք է առաջադրվել ՀՀ ՊՆ ՌՈ բաժանմունքի պետին:
Կատարված բազմակողմանի քննությամբ փաստական տվյալներ են ձեռք բերվել առ այն, որ Մ. Մ.-ը, հանդիսանալով հետաքննության մարմնի աշխատակից, իսկ 30.11.2015թ սկսած՝ հետաքննության մարմնի ղեկավար, չարաշահել է պաշտոնեական լիազորությունները, այն է՝ 2014 թվականի հոկտեմբերին տեղեկանալով իր ծանոթ, ՌԴ քաղաքացի Է. Մ-ի որդու՝ Վ. Մ-ի՝ ՌԴ իրավապահ մարմինների կողմից հետախուզման մեջ գտնվելու և քրեական պատասխանատվությունից ու պատժից խուսափելու նպատակով Հայաստանի Հանրապետություն ժամանելու մասին՝ չի կատարել իր ծառայողական պարտականությունները՝ Վ.Մ.-ի քրեական պատասխանատվության ենթարկվելն ապահովելու համար, որն էական վնաս է պատճառել պետության օրինական շահերին:
Բացի այդ, 2014թ. հոկտեմբեր ամսից մինչև 2016թ. հունվար ամիսն ընկած ժամանակահատվածում կատարել է հանցանք կատարած անձ Վ. Մ.-ի պարտակում:
Այնուհետև, իր պաշտոնեական դիրքն օգտագործելով՝ Վ. Մ.-ի օգտին գործողություն կատարելուն նպաստելու նպատակով պահանջել և ստացել է առանձնապես խոշոր չափերի կաշառք, այն է՝ գումարի դիմաց, իր լիազորությունների շրջանակներում, Վ. Մ.-ի՝ ՌԴ իրավապահ մարմինների կողմից հետախուզման, ինչպես նաև նրան ՀՀ քաղաքացիություն շնորհելու հարցերը կարգավորելու, իսկ հետագայում՝ նաև զինվորական գրքույկ տրամադրելու վերաբերյալ համաձայնություն է ձեռք բերել վերջինիս հոր՝ Է.Մ.-ի հետ, ապա 2014 թվականի հոկտեմբերից մինչև 2016թ. հունվար ամիսն ընկած ժամանակահատվածում, պարբերաբար, կանխիկ և բանկային փոխանցումների միջոցով, որպես կաշառք անձամբ ստացել է առանձնապես խոշոր չափերի՝ 68.160.000 ՀՀ դրամին համարժեք, ընդհանուր 6.000.000 ՌԴ ռուբլի գումար:
Բացի այդ, գնդապետը, գործելով առանձնապես խոշոր չափերով ուրիշի գույքի հափշտակություն կատարելու ուղղակի դիտավորությամբ, 2015թ. նոյեմբեր ամսին, Վ.Մ.-ի նկատմամբ բռնություն գործադրելու, ինչպես նաև նրա ծնողների՝ ՌԴ Նախոդկա քաղաքում գտնվող գույքն իր ընկերների միջոցով վնասելու սպառնալիքով Վ.Մ.-ին ներկայացրել է իր օգտին գույքային գործողություն կատարելու՝ առանձնապես խոշոր չափերի՝ 7.160.000 ՀՀ դրամին համարժեք, 1.000.000 ՌԴ ռուբլի գումար տալու պահանջ:
Ձեռք բերված բավարար ապացույցների համակցությամբ՝ գնդապետին մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասով, ՀՀ քրեական օրենսգրքի 334-րդ հոդվածի 1-ին մասով, ՀՀ քրեական օրենսգրքի 311-րդ հոդվածի 4-րդ մասի 2-րդ կետով և ՀՀ քրեական օրենսգրքի 182-րդ հոդվածի 3-րդ մասի 2-րդ կետով, և նրա նկատմամբ որպես խափանման միջոց է ընտրվել կալանավորումը:
Քրեական գործով նախաքննությունը շարունակվում է:
Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
