Կառավարությունը մերժեց «Լուսավոր Հայաստան»-ի ներկայացրած օրենքի նախագիծը

Կառավարությունն այսօր՝ օգոստոսի 15-ի հերթական նիստում մերժեց ՀՀ ԱԺ «Լուսավոր Հայաստան» խմբակցության կողմից ներկայացված օրենքի նախագիծը։ 

«Կառավարության կառուցվածքի եւ գործունեության մասին» Հայաստանի Հանրապետության օրենքում լրացում կատարելու մասին» Հայաստանի Հանրապետության օրենքի նախագծով առաջարկվում էր սահմանել, որ կառավարության նիստում առանց քննարկման եւ զեկուցման քվեարկության կարգը չի կարող կիրառվել Ազգային ժողովի պատգամավորի կամ խմբակցության կողմից ներկայացված օրենքի նախագծերի նկատմամբ։

Ըստ հիմնավորման՝ պատգամավորի կամ խմբակցության կողմից ներկայացված օրենքի նախագծի քննարկման ընթացքը սահմանող իրավական ակտերով սահմանված են այնպիսի ընթացակարգեր, որ օրենքի նախագիծը մինչեւ կառավարության նիստում քվեարկվելը, բավական երկարատեւ գործընթաց է անցնում՝ քննարկվելով տարբեր ձեւաչափերով, այդ թվում՝ նախարարական կոմիտեների նիստերում:

Արդարադատության նախարար Ռուստամ Բադասյանն օրենքի նախագծի առնչությամբ ասաց. «Միաժամանակ բավարար երաշխիքներ են սահմանված ներկայացված նախագծի պատշաճ քննարկումն ապահովելու նպատակով, քանի որ ի թիվս այլ հանգամանքների կառավարության մեկ անդամի առաջարկության դեպքում նախագիծը ենթակա է քննարկման։ Անհրաժեշտ ենք համարում ընդգծել, որ բոլոր նախագծերի համար պարտադիր քննարկման ռեժիմ սահմանելը կարող է անհարկի ծանրաբեռնել կառավարության նիստը։ Բացի այդ, գտնում ենք, որ կառավարությունը պետք է ազատ լինի իր նիստի օրակարգում ընդգրկված հարցերի հետագա ընթացքի կազմակերպման կարգում, իսկ պատգամավորի կամ խմբակցության կողմից ներկայացված նախագծերի պարտադիր քննարկման ռեժիմ սահմանելը չի կարող արդարացված լինել կառավարության անդամների գործունեության երաշխիքների ապահովման տեսանկյունից»։

Փոխվարչապետ Տիգրան Ավինյանն էլ հավելեց, որ պատգամավորի կամ խմբակցության կողմից ներկայացված օրենքի նախագծերի քննարկումը բավականին կարճ ժամկետներում է տեղի ունենում. «Ընդհանուր առմամբ 30 օր է տեւում,  ժամանակ առ ժամանակ կառավարությունն իր դիրքորոշումները  չի հասցնում համապարփակ հայտնել եւ լինում են գերատեսչություններ, որոնք տարատեսակ կարծիքներ են ունենում նախագծերի վերաբերյալ։ Մենք աշխատում են Աժ մեր գործընկերների հետ, որ որոշակի փոփոխություններ մտցնենք «ԱԺ կանոնակարգ» օրենքի հետ կապված, ինչպես նաեւ կարծում ենք, որ նման նախագծերը եւս պետք է դրվեն հանրային քննարկման որեւէ հարթակում, կառավարությունը պատրաստ է ապահովել այդ հարթակը եւ ամփոփել ամբողջական կարծիքները, ամփոփված փաթեթներով ուղարկել Աժ»։
