ԲԴԽ–ի հանձնարարությամբ՝ ուսումնասիրվել է Քոչարյանի և մյուսների գործի մակագրման հարցը
POLITICSԴատական դեպարտամենտը պարզաբանում է տարածել «Ռոբերտ Քոչարյանը և մյուսները» քրեական գործի մակագրման ընթացակարգի վերաբերյալ։
«Բարձրագույն դատական խորհրդի հանձնարարությամբ կատարվել է համապատասխան ուսումնասիրություն, որի արդյունքում տեղեկացվում է.
«Ռոբերտ Քոչարյանը և մյուսները» քրեական գործով «Սահմանադրական դատարան դիմելու և գործի վարույթը կասեցնելու մասին» Երևան քաղաքի առաջին ատյանի ընդհանուր իրավասության դատարանի 20.05.2019թ. որոշման դեմ բերված վերաքննիչ բողոքի քննության արդյունքում ՀՀ վերաքննիչ քրեական դատարանի կողմից 25.06.2019թ. որոշում է կայացվել բողոքը բավարարվելու և քրեական գործը նույն դատարան նոր քննության ուղարկելու մասին: Հիշյալ որոշման դեմ (15.07.2019թ., 18.07.2019թ., 25.07.2019թ., 29.07.2019թ.) ներկայացվել են վճռաբեկ բողոքներ: Միաժամանակ հարկ է նշել, որ «Ռոբերտ Քոչարյանը և մյուսներ»-ի վերաբերյալ քրեական գործը ՀՀ վճռաբեկ դատարան է ստացվել (մուտքագրվել) 06.08.2019թ.:
Այսպես՝ ՀՀ քրեական դատավարության օրենսգրքի «Վճռաբեկ բողոքը վարույթ ընդունելու հիմքերը» վերտառությամբ 414.2-րդ հոդվածի 5-րդ մասի համաձայն՝ «Վճռաբեկ բողոքը վարույթ ընդունելու մասին վճռաբեկ դատարանը կայացնում է որոշում` գործը վճռաբեկ դատարանում ստանալու օրվանից երեք ամսվա ընթացքում»:
ՀՀ քրեական դատավարության օրենսգրքի «Վճռաբեկ բողոքը վարույթ ընդունելը մերժելը» վերտառությամբ 414.3-րդ հոդվածի 3-րդ մասի համաձայն՝ «Վճռաբեկ բողոքը վարույթ ընդունելը մերժելու մասին վճռաբեկ դատարանը կայացնում է որոշում գործը վճռաբեկ դատարանում ստանալու պահից երեք ամսվա ընթացքում»:
Այսպիսով, թեպետ «ՀՀ դատական օրենսգիրք» սահմանադրական օրենքի` «Գործերի վերաբաշխումը» վերտառությամբ 46-րդ հոդվածի 1-ին մասի համաձայն՝ «Եթե դատավորը գործուղվել է, նրա գործուղման ժամկետն ավարտվել է, նա տեղափոխվել է այլ դատարան, տեղի է ունեցել դատավորների պաշտոնների փոխանակում, տվյալ գործով հայտնել է ինքնաբացարկ, նախկինում մասնակցել է տվյալ գործի քննությանը, գործի հարուցումը մերժել է, որի վերաբերյալ որոշումը սահմանված կարգով վերացվել է, նրա լիազորությունները կասեցվել, դադարել կամ դադարեցվել են, ապա տվյալ դատավորին հանձնված գործերը վերաբաշխվում են տվյալ դատարանի համապատասխան մասնագիտացում ունեցող այլ դատավորների միջև»: Սակայն, հաշվի առնելով այն հանգամանքը, որ «Ռոբերտ Քոչարյանը և մյուսներ»-ի վերաբերյալ քրեական գործը 06.08.2019թ. մուտքագրվել է ՀՀ վճռաբեկ դատարան և այն գտնվում է ՀՀ քրեական դատավարության օրենսգրքի 414.2-րդ հոդվածի 5-րդ մասի և 414.3-րդ հոդվածի 3-րդ մասի իրավակարգավորումների տիրույթում, նշված պայմաններում չեն կարող իրացվել «ՀՀ դատական օրենսգիրք» սահմանադրական օրենքի 46-րդ հոդվածի 1-ին մասին իրավակարգավորումները:
Ամփոփելով վերոգրյալը՝ հարկ է նշել, որ «Ռոբերտ Քոչարյանը և մյուսներ»-ի վերաբերյալ քրեական գործն առաջին ատյանի ընդհանուր իրավասության դատարան ստացվելուն պես կիրացվի «ՀՀ դատական օրենսգիրք» սահմանադրական օրենքի համապատասխան պահանջը»,-նշված է հայտարարության մեջ։
