Նոր տույժեր, 25–ամյա դատավորներ. ի՞նչ է նախատեսվում դատական համակարգի փոփոխություններով
POLITICSՀՀ արդարադատության նախարարությունը հանրային քննարկման է ներկայացրել «Դատական օրենսգրքում փոփոխություններ և լրացումներ կատարելու մասին» օրենքի նախագիծը, որով դատավորների վերաբերյալ մի քանի ուշագրավ փոփոխություններ են նախատեսվում։
Նախագծով առաջարկվում է դատավորների թեկնածուների տարիքային շեմը 28–ից իջեցնել 25–ի։
Արդարադատության նախարարությունը, վկայակոչելով միջազգային փորձը, բերում է Էստոնիայի, Նորվեգիայի, Ռուսաստանի օրինակը։ Մասնավորապես, Նորվեգիայում շրջանային և վերաքննիչ դատարանների դատավորների նվազագույն տարիքը 25-ն է: Միևնույն տարիքն է սահմանված նաև Թայլանդում, Ռուսաստանի Դաշնությունում, Բելառուսում:
Նախագծով հստակեցվել են նաև դատավորի վարքագծի կանոնները և կարգապահական պատասխանատվության ենթարկելու հիմքերը: Մասնավորապես, դատավորի վարքագծի կանոններից հանվել են այն կանոնները, որոնք բնույթով ոչ թե կարգապահական, այլ էթիկայի կանոններ են, որոնց համար դատավորին կարգապահական պատասխանատվության ենթարկելը, ըստ նախարարության, կամ արդարացված չէ կամ հնարավոր չէ՝ նորմի անորոշ, չափազանց լայն ձևակերպման պատճառով:
Միևնույն ժամանակ, ավելացվել են այնպիսի վարքագծի կանոններ, որոնց խախտումը կասկածի տակ է դնում դատավորի անկախությունը, անկողմնակալությունը և անկաշառությունը, օրինակ՝ ներկայացնել գույքի, եկամուտների և շահերի ամբողջական հայտարարագիր։ Նախատեսվել է նաև դատավորների թեկնածուների հավակնորդների հայտարարագրման պարտականությունը: Նախագծով ընդլայնվել են կարգապահական տույժերի տեսակները: Մասնավորապես, գործող օրենսգրքով ամրագրված՝ միայն ամենամեղմ և ամենախիստ կարգապահական տույժի տեսակներին ավելացել են միջին խստության տույժեր՝ պատասխանատվության պատշաճ և համաչափ գործիքներ ներդնելու նպատակով: Նոր տույժի տեսակներն են՝ առաջխաղացման ենթակա դատավորների թեկնածուների ցուցակի հերթական համալրման ժամանակ ցուցակում ընդգրկվելու արգելքը և դատարանի նախագահի կամ Վճռաբեկ դատարանի պալատի նախագահի պաշտոնից ազատումը:
