ՀՀ ԱԱԾ-ն պետք է բացահայտի դավաճանին կամ դավաճանների խմբին

«ՀՀ ԱԱԾ-Ն ՊԵՏՔ Է ԲԱՑԱՀԱՅՏԻ ԴԱՎԱՃԱՆԻՆ
Անկախ այն բանից, թե համապատասխանում են արդյոք ճշմարտությանն այսօր «Բի-բի-սի»-ի հրապարակած տեղեկությունները Երևանում 2008 թ. մարտի 1-ի սպանությունների գործով, ինձ՝ որպես Հայաստանի Հանրապետության շարքային քաղաքացու, այս պատմության մեջ խիստ անհանգստացնում է մեկ ուրիշ հարց ևս, այն է՝ ո՞վ և ինչպե՞ս է տրամադրել այդ գաղտնի փաստաթղթերը (ներառյալ հարցաքննությունների ձայնագրությունը կամ սղագրությունը) բրիտանական հետախուզության հետ սերտորեն կապված Բրիտանական հեռարձակման կորպորացիային (եթե իրոք այդպիսի փաստաթղթեր գոյություն ունեն և եթե դրանք իրոք գտնվում են օտարերկրյա կազմակերպության տրամադրության տակ)։
Պատկերացնենք հակառակ իրավիճակը. Սկրիպալների թունավորման գործով բրիտանական հետաքննության գաղտնի փաստաթղթերը հրապարակում է Հայաստանի հանրային ռադիոն կամ Ռուսական ОРТ-ն։ Նման արտահոսքի հեղինակին բացահայտելու համար անմիջապես հետախուզում կսկսվեր, իսկ նրա արարքը պետական դավաճանություն կորակվեր։
Արդ, հաշվի առնելով հարցի լրջությունը Հայաստանի ազգային անվտանգության համար, մարտի 1-ի գործի հետաքննության նյութերի տրամադրումն օտարերկրյա լրատվամիջոցին պետական դավաճանության պարզորոշ դեպք է։ ՀՀ ԱԱԾ-ն պետք է բացահայտի դավաճանին կամ դավաճանների խմբին, այլապես նրանց վնասարարությունն անխափան շարունակվելու է՝ անկանխատեսելի ծանր հետևանքներով հանդերձ։

Հոդված 299. Պետական դավաճանությունը
1. Պետական դավաճանությունը՝ թշնամու կողմն անցնելը, լրտեսությունը, օտարերկրյա պետությանը կամ օտարերկրյա կազմակերպությանը կամ դրանց ներկայացուցիչներին պետական գաղտնիք հանձնելը կամ թշնամական գործունեություն իրականացնելու համար այլ օգնություն ցույց տալը, որը կատարել է Հայաստանի Հանրապետության քաղաքացին՝ ի վնաս Հայաստանի Հանրապետության ինքնիշխանության, տարածքային անձեռնմխելիության կամ արտաքին անվտանգության, պատժվում է ազատազրկմամբ՝ տասից տասնհինգ տարի ժամկետով՝ գույքի բռնագրավմամբ կամ առանց դրա:
2. Սույն հոդվածով, ինչպես նաև սույն օրենսգրքի 302-րդ հոդվածով նախատեսված հանցանքներ կատարած անձն ազատվում է քրեական պատասխանատվությունից, եթե նա, իշխանության մարմիններին կամովին հայտնելով կամ այլ ձևով, օժանդակել է հետագա վնասը կանխելուն, և եթե նրա գործողություններն այլ հանցակազմ չեն պարունակում»,- գրել է նա:
