Երեւանի քաղաքապետարանն արգելափակում է Ռոբերտ Քոչարյանի գրքի գովազդը. փաստաբան
VIDEOԵրեւանի քաղաքապետարանն արգելափակում է Ռոբերտ Քոչարյանի «Կյանք եւ ազատություն» գրքի գովազդը: Այս մասին հայտարարվեց երկրորդ նախագահի գրասենյակի համակարգող Բագրատ Միկոյանի եւ փաստաբան Ալեքսանդր Կոչուբաեւի համատեղ մամուլի ասուլիսում:
Բագրատ Միկոյանի խոսքով՝ գովազդի թույլտվության համար քաղաքապետարան դիմելու հերոսապատումը շարունակվում է արդեն մոտ կես տարի: Ընդ որում՝ գրքի վաճառքի հետ կապված խնդիրներ չկան՝ Հայաստանում գիրքը ամենատարածված գրքերի տասնյակում է եւ բեսթսելեր է Մոսկվայում: Հիշեցնենք, որ գիրքը հրատարակվել է հայերեն եւ ռուսերեն:
Խնդիրն ավելի մանրամասն ներկայացրեց Ալեքսանդր Կոչուբաեւը: Նրա խոսքով՝ դեռեւս ապրիլին իրենք դիմել են քաղաքապետարան գովազդի թույլտվություն ստանալու համար: «Ես զարմացած եմ վարչարարության խնդրի հետ կապված քաղաքապետարանում տեղի ունեցողից: Սա այն բանի քրեստոմատիական օրինակն է, թե ինչպես չպետք է լինի»,- արձանագրեց փաստաբանը:
Պարզվել է, որ դիմումը ներկայացվել է ապրիլի վերջին: Քաղաքապետարանը մինչեւ հիմա ոչ մերժել է, ոչ բավարարել: Պարզվել է նաեւ, որ հենց այս դեպքում է նախկինում գործող կարգը՝ դիմում, այնուհետեւ տուրքի վճարում, հանկարծ փոխվել, եւ անհրաժեշտ էր նախ վճարել տուրքը եւ անդորրագիրը ներկայացնել դիմումի հետ միասին: Խնդիրը շտկվել է, տուրքը վճարված է, բայց սայլը տեղից չի շարժվում: Ուշագրավ է, որ քաղաքապետարում չեն մտահոգվել պարզաբանելու առաջին դիմումի մերժման պատճառը՝ սահմանափակվելով պահանջներին չհամապատասխանելու ձեւական նշումով:
Արաբկիր եւ Կենտրոն շրջանների թաղապետարանների միջոցով դիմելու փորձերը նույն արդյունքն ունեցան՝ պատասխան չկա:
Քանի որ օրենքով սահմանված բոլոր ժամկետներն անցել են, իսկ պետական մարմինն ՝ ի դեմս քաղաքապետարանի, շարունակում է անգործության մատնվել, նույն օրենքի համաձայն, դիմող կողմը գովազդի իրավունք է ստանում՝ անկախ քաղաքապետարանի հետագա գործողություններից, հիշեցրեց փաստաբանը:
Միեւնույն ժամանակ, քանի որ «Սփեյս մենեջմենթ» ՍՊԸ-ն մտադիր է հետագայում էլ գործել ըստ օրենքի, նույնն ակնկալում է նաեւ քաղաքապետարանից եւ խնդրում է տրամադրել փաստաթուղթ, որը թույլատրում է գրքի գովազդը:
Այն տրամադրելու համար որպես խելամիտ ժամկետ ՍՊԸ ներկայացուցիչները պատրաստ են 24 ժամ հատկացնել՝ հակառակ դեպքում վաղը օրվա երկրոդ կեսին փաստաբանը դիմում կներկայացնի Վարչական դատարան:
