Խուզարկություն և առգրավում.որո՞նք են տարբերությունները
SOCIETY«Փաստ» օրաթերթը շարունակում է ներկայացնել «Ճանաչեք և պաշտպանեք ձեր իրավունքները» խորագիրը: Շատ են դեպքերը, երբ քաղաքացիները չեն կարողանում պաշտպանել իրենց իրավունքները, քանի որ իրազեկված չեն, իսկ երբեմն էլ որոշ պետական հիմնարկներ էլ ավելի են շփոթեցնում նրանց:
Օրաթերթը, համագործակցելով ՀՀ փաստաբանների պալատի հետ, այսուհետ հանրային իրազեկման արշավ է կազմակերպում, որը կօգնի մեր քաղաքացիներին իմանալ և պաշտպանել իրենց իրավունքները: Նշենք նաև, որ յուրաքանչյուր հինգշաբթի՝ ժամը 10:00-ից մինչև 17:00-ն փաստաբանների պալատի հանրային պաշտպանի գրասենյակն անվճար խորհրդատվություն է տրամադրում ՀՀ բոլոր քաղաքացիներին:
Հարց- Ո՞րն է խուզարկության և առգրավման տարբերությունը:

-Ե՛վ խուզարկության, և՛ առգրավման համար գործողությունն իրականացնողը (քննիչը) պետք է ունենա որոշակի հիմքեր:
Եթե խուզարկության ժամանակ բավարար է միայն քննիչի ենթադրությունն այն մասին, որ խուզարկվող օբյեկտում կարող են լինել հանցագործության գործիքներ, հանցավոր ճանապարհով ձեռք բերված առարկաներ ու արժեքներ, ինչպես նաև այլ առարկաներ և փաստաթղթեր, որոնք կարող են նշանակություն ունենալ գործի համար, ապա առգրավման դեպքում պատկերն այլ է:
Առգրավում կարող է կատարվել, եթե ստույգ հայտնի է, թե որտեղ և ում մոտ են դրանք գտնվում:
Քննիչը, բավարար հիմքեր ունենալով ենթադրելու, որ որևէ շենքում կամ այլ տեղ կամ որևէ անձի մոտ գտնվում են հանցագործության գործիքներ, հանցավոր ճանապարհով ձեռք բերված առարկաներ ու արժեքներ, ինչպես նաև այլ առարկաներ և փաստաթղթեր, որոնք կարող են նշանակություն ունենալ գործի համար, խուզարկություն է կատարում դրանք գտնելու և վերցնելու համար: Խուզարկություն կարող է կատարվել նաև հետախուզվող անձանց, հանցագործություն կատարելու մեջ կասկածվող անձանց, ինչպես նաև դիակները հայտնաբերելու համար:
Բնակարանի խուզարկությունը կատարվում է միայն դատարանի որոշմամբ:
Գործի համար նշանակություն ունեցող որոշակի առարկաներ և փաստաթղթեր վերցնելու անհրաժեշտության դեպքում և, եթե ստույգ հայտնի են, թե որտեղ և ում մոտ են դրանք գտնվում, քննիչը կատարում է առգրավում: Այն փաստաթղթերի առգրավումը, որոնք պարունակում են պետական գաղտնիք, կատարվում է միայն դատախազի թույլտվությամբ` համապատասխան հիմնարկի ղեկավարի հետ համաձայնեցված կարգով:
Ձեռնարկությունները, հիմնարկները, կազմակերպությունները, պաշտոնատար անձինք և քաղաքացիներն իրավունք չունեն հրաժարվել քննիչին հանձնելու այն առարկաները, փաստաթղթերը կամ դրանց պատճենները, որոնք պահանջվել են նրա կողմից:
