ՀՀ ազգային անվտանգության ծառայության քննչական դեպարտամենտում հարուցված քրեական գործի նյութերի հիման վրա, ՀՀ գլխավոր դատախազի պաշտոնակատարի որոշմամբ, խոշոր չափերով կաշառք ստանալու համար ՀՀ գլխավոր դատախազության վարչության ավագ դատախազ Լ. Կ-ն  ՀՀ քրեական օրենսգրքի 311-րդ հոդվածի 3-րդ մասով ներգրավվել է որպես մեղադրյալ: Այս մասին NEWS.am-ին հայտնում են ՀՀ Քննչական կոմիտեից:

Քրեական գործով առերևույթ տվյալներ են ձեռք բերվել այն մասին, որ ՀՀ գլխավոր դատախազության վարչության ավագ դատախազը, ծանրացուցիչ հանգամանքներում ավազակություն կատարելու համար ՀՀ քրեական օրենսգրքի   175-րդ հոդվածի 3-րդ մասի 3-րդ կետով  2013 թվականին 10 տարի ժամկետով ազատազրկման դատապարտված և համապատասխան քրեակատարողական հիմնարկում պատիժ կրող Գ. Գ.-ին պատժի կրումից պայմանական վաղաժամկետ ազատելու հարցի հետ կապված, իր պաշտոնեական դիրքի օգտագործմամբ, նշված դատավարական գործընթացին միջամտելու՝ այն է՝ դատապարտյալի կողմից պատժից պայմանական վաղաժամկետ ազատելու վերաբերյալ միջնորդագրի քննարկման ընթացքում տվյալ վարույթին մասնակցող դատախազի կողմից դրան չառարկելու, դատարանի կողմից պատժից պայմանական վաղաժամկետ ազատելու վերաբերյալ միջնորդագիրը բավարարելու դեպքում այն չբողոքարկելու և դրանով պայմանավորված դատապարտյալի համար ցանկալի արդյունքի ապահովմանը նպաստելու համար, դատապարտյալի մտերիմ անձից 2019 թվականի հունիս ամսին պահանջել, ապա մաս-մաս ստացել է խոշոր չափերով կաշառք:

Նախաքննությունը շարունակվում է, քրեական գործով պատշաճ դատախազական հսկողության ներքո ձեռնարկվում են միջոցներ գործի հանգամանքների բազմակողմանի, լրիվ և օբյեկտիվ քննությունն ապահովելու ուղղությամբ:

Հիշեցնենք, որ ՀՀ գլխավոր դատախազ Արթուր Դավթյանը ինչպես հրապարակային ելույթների, այնպես էլ աշխատանքային բնույթի միջոցառումների, խորհրդակցությունների ընթացքում բազմիցս հայտարարել է դատախազների կողմից կոռուպցիոն հանցագործություններ կատարելու, դրանցում ցանկացած ձևով նրանց ներգրավվելու անթույլատրելիության, դրանից ձեռնպահ մնալու անհրաժեշտության մասին: Բազմիցս զգուշացվել է, որ նման ցանկացած դեպքում, բավարար հիմքերի առկայությամբ, դատախազության վերաբերմունքը լինելու է աներկբա և բազմակի անգամ ավելի խիստ, իսկ մեղադրանքի հիմնավորման պարագայում՝ առաջնորդվելու է կատարած հանցանքին համարժեք, օրենքի ողջ խստությամբ պատասխասխանատվաթյան ենթարկումն ապահովելու սկզբունքով:

Հարգելով անմեղության կանխավարկածը՝ ՀՀ դատախազությունը շարունակում է գործել այդ հավատամքով, տվյալ քրեական գործի շրջանակներում իրականացնելու է պատշաճ դատավարական հսկողություն և թույլատրելիության սահմաններում ապահովելու է քրեական գործի հրապարակայնությունը:
