Աշխատանքային հարաբերություններ.ի՞նչ պետք է իմանալ
SOCIETY«Փաստ» օրաթերթը շարունակում է ներկայացնել «Ճանաչեք և պաշտպանեք ձեր իրավունքները» խորագիրը: Շատ են դեպքերը, երբ քաղաքացիները չեն կարողանում պաշտպանել իրենց իրավունքները, քանի որ իրազեկված չեն, իսկ երբեմն էլ որոշ պետական հիմնարկներ էլ ավելի են շփոթեցնում նրանց:
Օրաթերթը, համագործակցելով ՀՀ փաստաբանների պալատի հետ, այսուհետ հանրային իրազեկման արշավ է կազմակերպում, որը կօգնի մեր քաղաքացիներին իմանալ և պաշտպանել իրենց իրավունքները: Նշենք նաև, որ յուրաքանչյուր հինգշաբթի՝ ժամը 10:00-ից մինչև 17:00-ն փաստաբանների պալատի հանրային պաշտպանի գրասենյակն անվճար խորհրդատվություն է տրամադրում ՀՀ բոլոր քաղաքացիներին:
Աշխատանքային հարաբերություններին վերաբերող հարցին պատասխանում է փաստաբան Տաթևիկ Շալջյանը:
-Համաձայն ՀՀ աշխատանքային օրենսգրքի 14-րդ հոդվածի աշխատողի և գործատուի միջև աշխատանքային հարաբերությունները ծագում են աշխատանքային օրենսդրությամբ սահմանված կարգով կնքված գրավոր աշխատանքային պայմանագրով կամ կողմերի համաձայնությամբ` աշխատանքի ընդունման մասին անհատական իրավական ակտով:
Այս կապակցությամբ ՀՀ Սահմանադրական դատարանն իր 18.07.2012թ. ՍԴՈ-1038 որոշմամբ նշել է.
«ՀՀ աշխատանքային և քաղաքացիական օրենսգրքերի վերաբերելի նորմերի համադրված վերլուծության արդյունքում Սահմանադրական դատարանը գտնում է, որ ՀՀ աշխատանքային օրենսգրքի վիճարկվող նորմը, որպես աշխատանքային իրավահարաբերությունների ծագման միակ հիմք սահմանելով աշխատանքային պայմանագիրը, չի բացառում գրավոր աշխատանքային պայմանագրի բացակայության պայմաններում աշխատանքային հարաբերություններից բխող աշխատանքային պարտականությունների փաստացի կատարման առկայության ապացուցման դեպքում անձի իրավունքների, այդ թվում՝ փաստացի կատարված աշխատանքի դիմաց վարձատրության պահանջի իրավունքի, արդյունավետ պաշտպանության հնարավորությունը: Տվյալ դեպքում առկա է իրավունքի պաշտպանության խնդիր և հարցի նկատմամբ չի կարող ձևական մոտեցում դրսևորվել:
ՀՀ օենսդրության և ՀՀ միջազգային պարտավորությունների համադրված վերլուծությունը վկայում է, որ յուրաքանչյուր կոնկրետ դեպքում աշխատանքային պարտականությունների կատարման առկայության հիմնավոր ապացույցներով փաստումը հիմք է առանց գրավոր աշխատանքային պայմանագրի կնքման իր աշխատանքային պարտականությունների կատարմանն անցած անձին իր իրավունքների, այդ թվում՝ համարժեք հատուցման պահանջի իրավունքի պաշտպանություն տրամադրելու համար: Սույն իրավական դիրքորոշումից շեղումը կհանգեցնի պատասխանատվության անտեսման և աշխատողի իրավունքների ոտնահարման, քանի որ կատարած փաստացի աշխատանքի դիմաց համարժեք հատուցում վճարելուց հրաժարվելը նաև անձի սեփականության իրավունքի ոտնահարում է... »:
Այս դեպքում ևս Դուք հնարավորություն ունեք օգտվելու Ձեր փաստացի կատարած աշխատանքի դիմաց վարձատրության պահանջի իրավունքից, որի համար անհրաժեշտ է ապացուցել աշխատանքային պարտականությունների կատարման առկայությունը, օրինակ՝ որպես աշխատավարձ փոխանցված էլեկտրոնային վճարման հանձնարարագրերով, տեղեկանքներով, կախված գործի բնույթից՝ պահանջագրերով, ապրանքագրերով, այսինքն այնպիսի ապացույցներով, որոնք կարող են փաստել տվյալ գործատուի հետ Ձեր ունեցած աշխատանքային հարաբերությունները:
