Վեթինգը անհրաժեշտ չէ, ուստի իշխանությունները համաձայնվել են այդ մտքից հրաժարվել. Արփինե Հովհաննիսյան
BLOGԱԺ նախկին փոխնախագահ Արփինե Հովհաննիսյանն իր ֆեյսբուքյան էջում գրել է․
«Վենետիկի հանձնաժողովի լիագումար նստաշրջանը ամփոփող փաստաթղթում Հայաստանին վերաբերող հատվածները հատկանշական են մի քանի դրվագներով: Եվ այսպես` հանձնաժողովը փաստել է`
1. «Նախկին նախագահ Ռ. Քոչարյանին անձնական երաշխավորությամբ ազատ արձակելու դատարանի որոշումից հետո վարչապետ Փաշինյանը կոշտ քննադատության ենթարկեց դատարաններին, ԿՈՉ ԱՐԵՑ իր կողմնակիցներին ԱՐԳԵԼԱՓԱԿԵԼ դատարանների մուտքերը, ինչպես նաև խոսեց դատական իշխանության նորացման մասին: Հանձնաժողովի նախագահը (Բուքիքիոն) վարչապետին ուղղված իր նամակում, թեև ընդունեց, որ կա անվստահություն դատարանների նկատմամբ, սակայն ՊՆԴԵՑ , որ բոլոր ձեռնարկված միջոցները պետք է իրականացվեն Սահմանադրությանը և միջազգային չափանիշներին համապատասխան»:
1.1. Հայաստանի իշխանությունների հրավերով ՀՀ է ժամանել ԵԽ բարձրաստիճան պատվիրակություն` քննարկելու դատաիրավական բարեփոխումները:
«ՀԱՄԱՁԱՅՆՈՒԹՅՈՒՆ է ձեռք բերվել, որ բոլոր պաշտոնավարող դատավորների ընդհանուր ՎԵԹԻՆԳԸ ոչ անհրաժեշտ, ոչ էլ օգտակար կլինի: Փոխարենը, պետք է ամրապնդվեն կարգապահական ընթացակարգերը և ստեղծվի կապ եկամուտների հայտարարագրման համակարգի հետ»։
Կարծում եմ, կարիք չկա երկար-բարակ բացատրել, որ Վենետիկի հանձնաժողովի կարծիքով արգելափակման կոչը և դրան հետևած միջոցառումները չեն համարվել սահմանադրությանն ու միջազգային ստանդարտներին համապատասխան, ակնհայտ շարադրված է քաղաքական պատճառը այդ վարքագծի, դե իսկ վեթինգն էլ, մեղմ ասած, համադարման չէ, անհրաժեշտ չէ, օգտակար չէ, ուստի իշխանությունները համաձայնվել են այդ մտքից հրաժարվել, ինչն, իհարկե, խիստ խրախուսելի է:
2. Հանձնաժողովի մյուս կարևոր շեշտադրումը Սահմանադրական դատարանի շուրջ ստեղծված թնջուկին է վերաբերում: Հանձնաժողովը տեղեկացվել է Վահե Գրիգորյանի մեկնաբանություններին և արդյունքում շեշտել հետևյալը.
«Վերանայված սահմանադրության 213 հոդվածը, այդուհանդերձ, ՀՍՏԱԿ և ԱՆԵՐԿԲԱ սահմանում է, որ մինչև սահմանադրական փոփոխությունները ուժի մեջ մտնելը նշանակված ՍԴ նախագահը և անդամները պետք է ՇԱՐՈՒՆԱԿԵՆ ՊԱՇՏՈՆԱՎԱՐԵԼ մինչև 2005 թվականի սահմանադրությամբ նշված իրենց լիազորությունների ժամկետի ավարտը:
Անհանգստացնող է, որ դատավորի այս հայտարարությունը ողջունվել է խորհրդարանի կողմից և կա գործող դատավորների մանդատների նկատմամբ միջամտության վտանգ»։
Այստեղ ևս ամեն ինչ կարծում եմ հստակ է: Ավելորդ գունազարդ մեկնաբանությունների կարիք չկա՝ ՍԴ դատավոր և անդամ տարանջատումը մտացածին է։ Հավելեմ, որ հանձնաժողովը լիազորել է հանձնաժողովի նախագահ Զ. Բուքիքիոյին հետևել այս հարցի շուրջ զարգացումներին և ըստ անհրաժեշտության հանդես գալ հրապարակային հատարարությամբ»:
