«Փաստ» օրաթերթը շարունակում է ներկայացնել «Ճանաչեք և պաշտպանեք ձեր իրավունքները» խորագիրը: Շատ են դեպքերը, երբ քաղաքացիները չեն կարողանում պաշտպանել իրենց իրավունքները, քանի որ իրազեկված չեն, իսկ երբեմն էլ որոշ պետական հիմնարկներ էլ ավելի են շփոթեցնում նրանց:

Օրաթերթը, համագործակցելով ՀՀ փաստաբանների պալատի հետ, այսուհետ հանրային իրազեկման արշավ է կազմակերպում, որը կօգնի մեր քաղաքացիներին իմանալ և պաշտպանել իրենց իրավունքները: Նշենք նաև, որ յուրաքանչյուր հինգշաբթի՝ ժամը 10:00-ից մինչև 17:00-ն փաստաբանների պալատի հանրային պաշտպանի գրասենյակն անվճար խորհրդատվություն է տրամադրում ՀՀ բոլոր քաղաքացիներին:

Հարց- Ի՞նչ է փոխառության պայմանագիրը և ի՞նչ կարգով է կնքվում այն:

Պատասխանում է փաստաբան Նաիրա Համբարձումյանը:

- Փոխառության պայմանագրով մեկ կողմը (փոխատուն) մյուս կողմի (փոխառուի) սեփականությանն է հանձնում դրամ կամ տեսակային հատկանիշով որոշվող այլ գույք, իսկ փոխառուն պարտավորվում է փոխատուին վերադարձնել միևնույն գումարի դրամ (փոխառության գումարը) կամ փոխատուից ստացված գույքին հավասար քանակի և նույն տեսակի ու որակի գույք: 

Փոխառության պայմանագիրը կնքված է համարվում դրամ կամ այլ գույք հանձնելու պահից: Փոխառության պայմանագիրը կնքվում է գրավոր: Ի հավաստումն փոխառության պայմանագրի և դրա պայմանների` կարող է ներկայացվել փոխառուի տված ստացականը կամ փոխատուի կողմից փոխառուին որոշակի դրամական գումար կամ որոշակի քանակի գույք տալը հավաստող այլ փաստաթուղթ: Գրավոր ձևը չպահպանելը հանգեցնում է փոխառության պայմանագրի անվավերության: Նման պայմանագիրն առոչինչ է:

Փոխատուն իրավունք ունի փոխառության գումարից տոկոսներ ստանալ փոխառուից, եթե այլ բան նախատեսված չէ փոխառության պայմանագրով: Փոխառության պայմանագրում հստակ պետք է սահմանվեն տոկոսների չափը և հաշվարկման կարգը: Փոխառության պայմանագրի կնքման պահին տոկոսների չափը չի կարող գերազանցել Հայաստանի Հանրապետության կենտրոնական բանկի սահմանած բանկային տոկոսի հաշվարկային դրույքի կրկնապատիկը:

Փոխառությունը լինում է նաև նպատակային և պետական:

Նպատակային փոխառության դեպքում փոխառության պայմանագիրը կնքվում է փոխառուի կողմից ստացված միջոցները որոշակի նպատակների համար օգտագործելու պայմանով: Պայմանը խախտելու դեպքում փոխատուն իրավունք ունի փոխառուից պահանջել վաղաժամկետ վերադարձնել փոխառության գումարը և վճարել հասանելիք տոկոսները, եթե այլ բան նախատեսված չէ պայմանագրով:

Պետական փոխառության պայմանագրով` որպես փոխառու հանդես է գալիս Հայաստանի Հանրապետությունը, իսկ փոխատու` քաղաքացին կամ իրավաբանական անձը: Պետական փոխառության պայմանագիրը կնքվում է պետության կողմից թողարկված պետական այն պարտատոմսերը կամ պետական այլ արժեթղթերը փոխատուի կողմից ձեռք բերելու միջոցով, որոնք հավաստում են դրամական միջոցները, այլ գույքը, սահմանված տոկոսները կամ այլ գույքային իրավունքները փոխառության թողարկման պայմաններով նախատեսված ժամկետներում փոխառուից ստանալու փոխատուի իրավունքը:
