Արդարադատության նախարարությունը իրավական ակտերի նախագծերի հրապարակման միասնական՝ «E-draft.am» կայքում օրերս հանրային քննարկման է ներկայացրել մի շարք օրենքներում՝ այդ թվում՝ «ԶԼՄների մասին» օրենքում փոփոխություններ և լրացումներ կատարելու մասին նախագիծ: Նախարարությունը տեղեկացնում է, որ այս նախագծի նպատակը իրավաբանական անձանց պետական ռեգիստրի տվյալների բազան ԶԼՄ-ների համար անվճար դարձնելն է, այսինքն՝ օրենքում փոփոխություններ կատարելուց հետո լրատվամիջոցները ստիպված չեն լինի 3000 դրամ պետական տուրք վճարել անհրաժեշտ տեղեկատվությունը ստանալու համար:

Չնայած այդ պարզաբանմանը, լրագրողական համայնքն առաջարկվող փոփոխությունները միանշանակ չի ընդունում: Հարց բարձրացվեց՝ ինչո՞ւ նախագիծը նախքան «E-draft»-ում հայտնվելը չի քննարկվել շահագրգիռ կողմերի, մասնավորապես՝ լրագրողական համայնքի, հասարակական կազմակերպությունների հետ: Նախագծի հետ կապված իրենց մտահոգություններն էին արտահայտել նույնիսկ «Իմ քայլը» խմբակցության մի քանի պատգամավորներ: Նրանք գրել էին, որ լրատվամիջոցների հաշվառումն օրենքով ամրագրելը վատ գաղափար է։

Խնդիրը միայն օրենսդրական այս նախաձեռնությունը չէ, որի շուրջ նման աղմուկ է բարձրացել։ Հեղափոխությունից հետո կառավարությունը, որպես կանոն, հանդես է գալիս նախաձեռնություններով, որոնք խորհրդարանում հայտնվում են կամ վերջին պահին՝ քննարկումներից տառացիորեն ժամեր առաջ, կամ էլ՝ դրանց մասին հրապարակայնացվում է այն դեպքում, երբ իրազեկված չեն խորհրդարանի համապատասխան հանձնաժողովները կամ փորձագիտական շրջանակները։ Վերջերս արտառոց մեկ իրադարձություն էլ արձանագրվեց, երբ օրենքի նախագիծն ուղարկվել էր միջազգային փարձաքննության՝ առանց ներհանրապետական քննարկումների ձևաչափն անցնելու։

Հետհեղափոխական Հայաստանում խորհրդարանը լիովին ենթակա է գործադիր իշխանությանը։ Առանց վարանելու կարելի է պնդել, որ Երրորդ hանրապետության պատմության մեջ չի եղել ԱԺ, որն այսքան գրպանային լինի գործադիր իշխանության համար։ Նման իրավիճակներում խորհրդարանի քաղաքական, ինստիտուցիոնալ նշանակությունը փոշիացվում է, ինչը դիսկրիմինացնում է իշխանության ողջ համակարգը՝ ուժեղացնելով ավտորիտար միտումները։

Հեղափոխությունից հետո ճգնաժամ է ապրում նաև քաղաքացիական հասարակությունը։ Դրա մի շարք ներկայացուցիչներ ինտեգրվել են հեղափոխական իշխանությանն, ինչի հետևանքով հասարակության այս սեգմենտում առաջացել է վակուում։ Երբ հասարակությունը զրկվում է իշխանությանը վերահսկելու, իր օրակարգը ձևակերպելու հնարավորությունից, ավտորիտարիզմի հաստատման վտանգները մեծանում են, եթե նույնիսկ «վերևներում» նման ցանկություն կամ տրամադրություններ չկան։

Վերջին հաշվով՝ Հայաստանում գործում է սուպերվարչապետական համակարգ, որն ինստիտուցիոնալ հարթության վրա հակոտնյա է ժողովրդավարությանը ու ենթադրում է մեկ անձի վրա հիմնված իշխանության ձևավորում։ Առայժմ մենք գործ ունենք ավտորիտար կառավարման սաղմերի հետ, որոնք, սակայն, ժամանակի ընթացքում բյուրեղանալու հատկություն ունեն։ Ի վերջո, Երրորդ հանրապետության պատմությունն ապրել է նման փուլեր։
