Դատավոր Արմեն Դանիելյանը որոշեց կալանավորել Ռոբերտ Քոչարյանին

ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի և մյուսների բողոքները քննող Վերաքննիչ քրեական դատարանի դատավոր Արմեն Դանիելյանը քիչ առաջ վերադարձավ խորհրդակցական սենյակից և որոշում կայացրեց դատախազ Պետրոսյանի, տուժողների և նրանց իրավահաջորդների ներկայացուցիչների վերաքննիչ բողոքները բավարարել։
Միջդատական վարույթի ընթացքում, որպես խափանման միջոց ընտրված կալանավորման վերացման, փոփոխման կամ պահպանման հարցի  քննության առնելու մասին առաջին ատյանի դատարանի դատավոր Դավիթ Գրիգորյանի մայիսի 18–ի որոշումը բեկանել։
 Ռոբերտ Քոչարյանի նկատմամբ, որպես խափանման միջոց ընտրված անձնական երաշխավորությունը վերացնել, Քոչարյանի նկատմամբ, որպես խափանման միջոց ընտրել կալանավորումը։ Որոշման կատարումը հանձնարարել ՀՀ ոստիկանությանը, որպես անձնական երաշխավորություն մուծված գրավի գումարները վերադարձնել գրավատուներին։
 Դատավոր Արմեն Դանիելյանը, միևնույն ժամանակ որոշեց բավարարել դատախազների և տուժողների իրավահաջորդների մյուս բողոքը, որոշում կայացրեց քրեական գործի վարույթը կասեցնելու եւ Սահմանադրական դատարան դիմելու մասին Երևան քաղաքի ընդհանուր իրավասության առաջին դատարանի մայիսի 20–ի որոշումը բեկանել, գործն ուղարկել նույն դատարան նոր քննության 

Հիշեցնենք, որ Գլխավոր դատախազությունը և տուժող կողմը բողոքարկել են մայիսի 18-ի՝ Երեւան քաղաքի ընդհանուր իրավասության դատարանի՝ ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի նկատմամբ ընտրված խափանման միջոց կալանավորման որոշումը փոփոխելու եւ նույն դատարանի մայիսի 20֊ի՝ քրեական գործի վարույթը կասեցնելու եւ Սահմանադրական դատարան դիմելու որոշումը: Դատախազները պահանջում են փոխել Ռոբերտ Քոչարյանի նկատմամաբ ընտրված անձնական երաշխավորությունը և նրան կալանավորել, իսկ գործի վարույթը կասեցնելու դատարանի որոշումը բեկանել և կայացնել նոր դատական ակտ։

Ավելի վաղ հայտնել ենք, որ Երեւանի ընդհանուր իրավասության դատարանի դատավոր Դավիթ Գրիգորյանը մայիսի 18-ին, քննելով Քոչարյանի խափանման միջոցի հարցը, որոշել էր նրան ազատել կալանքից Արցախի Հանրապետության նախկին եւ ներկա նախագահներ Արկադի Ղուկասյանի եւ Բակո Սահակյանի անձնական երաշխավորությամբ:
Երկու օր անց՝ մայիսի 20-ին, դատարանը որոշել էր կասեցնել Ռոբերտ Քոչարյանի, Յուրի Խաչատուրովի, Սեյրան Օհանյանի եւ Արմեն Գեւորգյանի գործի վարույթն ու այն ուղարկել Սահմանադրական դատարան` պարզելու համար այս գործով կիրառման ենթակա ՀՀ քրեական օրենսգրքի 300.1-րդ հոդվածի 1-ին մասի եւ դրա հետ փոխկապակցված ՀՀ քրեական օրենսգրքի 300-րդ հոդվածի 1-ին մասի (մինչեւ 2009 թվականի մարտի 20-ին ընդունված ՀՕ-53-Ն օրենքի ուժի մեջ գտնվելը գործող խմբագրությամբ) համապատասխանությունը ՀՀ Սահմանադրության պահանջներին: ՍԴ–ն էլ օրերս որոշում է կայացրել մեկ ամսով երկարաձգել է Քոչարյանի եւ մյուսների գործով դատավորի դիմումն ուսումնասիրելու ժամկետը։
