Վահե Գրիգորյանը տուրք է տվել երևակայությանը: Այս մասին Tert.am-ի հետ զրույցում ասաց ԲՀԿ խմբակցության պատգամավոր, Պետաիրավական հարցերի մշտական հանձնաժողովի անդամ Գևորգ Պետրոսյանը՝ խոսելով ՍԴ դատավոր ընտրված Վահե Գրիգորյանի հայտարարության մասին, թե ինքը ստանձնում է ՍԴ նախագահի պաշտոնը:

 

 

 

«Երևակայելու իրավունքը որևէ նորմատիվ իրավական ակտով սահմանափակված չէ: Հավանաբար, հենց այդ հանգամանքից օգտվելով Վահե Գրիգորյանը տուրք է տվել երևակայությանը: Իրականում, եթե խոսենք ավելի լուրջ, չկա նման բան. ՍԴ-ն չի կարող բաղկացած լինել երկու դատավորից: Վահե Գրիգորյանի խոսքով ստացվում է, որ ՍԴ անդամներն իրավունք չունեն պաշտոնավարելու, որ ՍԴ-ում կա երկու դատավոր: Բայց այդ դեպքում ինչպե՞ս են երկու դատավորով ընտրելու ՍԴ նախագահ»,- նշեց Պետրոսյանը:

 

Պատգամավորը նշեց, որ «Վահե Գրիգորյանի համառությունը տեսանելի է, որևէ մեկը չի կասկածում նրա վեր խոյանալու անհագ ցանկության վրա», բայց տվյալ պարագայում նրա ցանկությունը չի տեղավորվում գործող օրենսդրության շրջանակներում:

 

 

 

Գևորգ Պետրոսյանն ասաց, որ ՍԴ-ն ունի նախագահ, և նա պետք է ազատվի զբաղեցված պաշտոնից, որպեսզի ընտրվի նոր նախագահ, հակառակ դեպքում ՍԴ գործող նախագահի լիազորությունները չեն կարող դադարեցված համարել:

 

Պատգամավորն ասաց, որ նպատակ կա ստեղծել հոգեբանական այնպիսի անցանկալի միջավայր, որ Հ. Թովմասյանը լքի պաշտոնը: «Այս պահին խոսել այն մասին, որ անդամները դատավոր չեն, դատավոր են միայն երկուսը, ու սա հիմք է, որ ինքը մեխանիկորեն դիտարկվի որպես ՍԴ նախագահ, ամոթալի ցանկություն է, որը չի տեղավորվում օրենքի շրջանակներում»,- ասաց նա:

 

Հիշեցնենք, որ Վահե Գրիգորյանը ՍԴ դատավորի պաշտոնը ստանձնելու երդման ժամանակ հայտարարել էր, որ ստանձնում է ՍԴ նախագահի պաշտոնը:

 

«Երբ խնդիրներ ունենում է Սահմանադրական դատարանը, այն էլ կազմի մեծամասնության մասով, դա արդեն խնդիր չէ, այլ ճգնաժամ է։ Բայց սա չի նշանակում, որ ճգնաժամերը լուծումներ չեն ունենում։ Երդումը տալուց, Սահմանադրական դատարան մուտք գործելիս, որպես Սահմանադրական դատարանում միակ դատավոր, որովհետև մյուս դատավորն այս օրերին բացակայում է, ես՝ ստանձնելով Սահմանադրական դատարանի նախագահի լիազորությունների և պարտականությունների կատարումը, Սահմանադրական դատարանի անդամների հետ խնդիրը քննարկելուց հետո, նրանց համաձայնությամբ կամ նրանց համախոհությամբ, կամ համաձայնության բացակայության դեպքում ընդունելի ձևաչափով այդ մասին կտեղեկացնեմ նաև հանրությանը և իշխանության համապատասխան սահմանադրական մարմիններին, որոնք իրավասու են գործընթացում դերակատարություն ունենալ»,-ասել էր Վահե Գրիգորյանը:
