POLITICSԴատախազի կողմից բավարարվել է մեղադրյալի՝ ՀՀ-ից ելքը չսահմանափակելուն ուղղված նրա պաշտպան Արայիկ Պապիկյանի բողոքը: Այս մասին իր ֆեյսբուքյան էջում հայտնել է ՀՀ գլխավոր դատախազի խորհրդական Գոռ Աբրահամյանը:
Նրա գրառումը ներկայացնում ենք ստորև.
«Փաստաբան Արայիկ Պապիկյանն օրեր առաջ «Ֆեյսբուք» սոցիալական ցանցի իր էջի միջոցով դիմել էր ՀՀ գլխավոր դատախազ Արթուր Դավթյանին՝ դժգոհելով ՀՀ քրեական օրենսգրքի 118-րդ հոդվածի հատկանիշներով քրեական գործում որպես մեղադրյալ ներգրավված իր պաշտպանյալին ամսվա մեջ որոշ օրերի աշխատանքի կատարման նպատակով հանրապետությունից բացակայելու թույլտվություն ստանալու մասին իրենց միջնորդությունը Լոռու մարզի դատախազի և քննիչի կողմից մերժվելու վերաբերյալ:
Այդ կապակցությամբ մեր կողմից պարզաբանվել էր, որ դատախազությունը չէր կարող տվյալ պահին այդ մասին դիրքորոշում արտահայտած լինել, քանի որ դատավարության որևէ կողմից դեռևս տեղեկատվություն չէր ստացել միջնորդությունը մերժելու և դրա հիմքերի վերաբերյալ:
Հունիսի 3-ին Լոռու մարզի դատախազությունը նախաքննական մարմնից ստացել է համապատասխան որոշումը, ինչպես նաև ստացել էր քննիչի նշված որոշման դեմ գործով պաշտպան Արայիկ Պապիկյանի բողոքը:
Նշված դատավարական փաստաթղթերի, քրեական գործի նյութերի ուսումանսիրությամբ պարզվել է, որ 2019 թվականի մայիսի 15-ին նրա պաշտպանյալի նկատմամբ որպես խափանման միջոց է ընտրվել ստորագրություն չհեռանալու մասին, վերջինս հարցաքննվել է որպես կասկածյալ, տվել խոստովանական ցուցմունք: 2019 թվականի մայիսի 22-ին վերջինիս մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 118-րդ հոդվածով:
Պարզվել է, որ տվյալ անձը 2019թ. ապրիլի 23-ից Ա/Ձ-ում աշխատում է որպես վարորդ և կատարում է բեռնափոխադրումներ՝ ՀՀ-ից ՌԴ և հակառակ ուղղությամբ:
Բացի այդ, ուսումնասիրությունից ակնհայտ է դարձել, որ նա քննության ողջ ընթացքում դրսևորել է պատշաճ վարքագիծ, քննիչի յուրաքանչյուր կանչով ներկայացել է վերջինիս, այդ թվում՝ ՀՀ-ից դուրս գտնվելու ընթացքում, և քրեական գործով ձեռք չեն բերվել փաստական այնպիսի տվյալներ, որ թույլ կտար կարծելու, թե ՀՀ-ից ելքի սահմանափակումը վերացնելու դեպքում վերջինս կարող է թաքնվել վարույթն իրականացնող մարմնից կամ խոչընդոտել քրեական գործով վարույթին:
Նկատի ունենալով վերոգրյալը, ինչպես նաև այն հանգամանքը, որ հանրապետությունից ելքի սահմանափակումը կարող է հանգեցնել աշխատանքի հնարավոր կորստով պայմանավորված նրա սոցիալական վիճակի վատթարացման՝ նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազի որոշմամբ վերացվել է Արայիկ Պապիկյանի պաշտպանյալի՝ ՀՀ-ից ելքի սահմանափակումը վերացնելու միջնորդությունը մերժելու մասին քննիչի որոշումը, բավարարվել վերջինիս դեմ պաշտպանի բողոքը: Բացի այդ համապատասխան գրություն է ուղարկվել ՀՀ ոստիկանության քրեական հետախուզության գլխավոր վարչություն՝ մեղադրյալի՝ ՀՀ-ից ելքի սահմանափակումը վերացնելու վերաբերյալ:
Այսինքն՝ նրան հնարավորություն է տրվել պատշաճ վարքագծի հետագա շարունակման պայմանով անխափան շարունակել աշխատանքային պարտականությունների կատարումը»:
