Երևանի մի քանի բենզալցակայաններում ստուգմամբ հայտնաբերված թերաչափման փաստերով քրեական գործեր են հարուցվել

Պետական գույքային շահերի արդյունավետ պաշտպանությունն ապահովելու նպատակով պետական շահերի պաշտպանության հայց հարուցելու լիազորությունների շրջանակներում Երևան քաղաքի դատախազության կողմից ուսումնասիրության է ենթարկվել 2017-18թթ. ընթացքում Երևան քաղաքում նավթամթերքի մանրածախ իրացմամբ զբաղվող տնտեսվարող սուբյեկտների կողմից ոչ պարենային արտադրանքի տեխնիկական կանոնակարգերով սահմանված պահանջների պահպանման, չափումների միասնականության ապահովման նկատմամբ պետական վերահսկողության իրականացման ոլորտը: Այս մասին հայտնում են ՀՀ գլխավոր դատախազությունից:

 

Այդ նպատակով անհրաժեշտ փաստաթղթեր և տեղեկություններ են պահանջվել ՀՀ Տնտեսական զարգացման և ներդրումների նախարարության շուկայի վերահսկողության տեսչական մարմնից և ՀՀ պետական եկամուտների կոմիտեից:

Ուսումնասիրությամբ պարզվել է, որ Շուկայի վերահսկողության տեսչական մարմնի ղեկավարի հրամանի հիման վրա նշված ժամանակահատվածում «Չափագիտության ազգային ինստիտուտ» ՓԲԸ-ի ներկայացուցչի ներգրավմամբ Երևան քաղաքի տարբեր հասցեներում գործող բենզալցակայաններում 10 լիտր տարողությամբ չափանոթի միջոցով իրականացվել են չափումներ: Դրանց արդյունքում արձանագրվել է դիզելային վառելիքի, ԱԻ 92 և ԱԻ 95 դասերի բենզինի՝ մինչև 1000 գրամի բացասական շեղումներ:

 

Պարզվել է, որ 2016թ. ՀՀ էկոնոմիկայի նախարարության Չափագիտության ազգային ինստիտուտ Չափագիտության ազգային մարմնի կողմից իրականացված՝ ավտոլիցքավորման աշտարակների ստուգաչափման արդյունքում այդ տնտեսվարող սուբյեկտներին տրվել է նավթամթերքի իրացմամբ զբաղվելու համապատասխան վկայականներ, որոնցում նշվել է, որ դրանք ուժի մեջ են կապարակնիքների առկայության դեպքում: Մինչդեռ պարզվել է, որ վարչական գործի վարույթում առկա չեն կապարակնիքների առկայության, բացակայության կամ դրանք վնասված լինելու մասին փաստաթղթեր։

Երևան քաղաքի դատախազությունում կատարված ուսումնասիրություններն ուղարկվել են Երևան քաղաքի համապատասխան վարչական շրջանների դատախազություններ, որոնց հանձնարարությամբ հետաքննության և նախաքննության մարմինների համապատասխան տարածքային ստորաբաժանումներում դրանց հիման վրա նախապատրաստվել են նյութեր: Արդյունքում մայրաքաղաքում գործող՝ նավթամթերքի մանրածախ իրացմամբ զբաղվող, անհատ ձեռներեցի կարգավիճակով գործող երեք տնտեսվարող սուբյեկտներում հայտնաբերված խախտումների և դրանց հետևանքով թերաչափելու, ապրանքի սպառողական հատկանիշների կամ որակի վերաբերյալ սպառողներին թյուրիմացության մեջ գցելու փաստերով ՀՀ ոստիկանության Երևան քաղաքի վարչության Էրեբունու բաժնում, ինչպես նաև ՀՀ ՔԿ ԵՔՔՎ Ավան և Նոր Նորք վարչական շրջանների քննչական բաժնում հարուցվել է 3 քրեական գործ՝ ՀՀ քրեական օրենսգրքի 212-րդ հոդվածի 1-ին մասի հատկանիշներով:

Քրեական գործերից 2-ի նախաքննությունն իրականացվում է ՀՀ ՔԿ Էրեբունի և Նուբարաշեն, 1-ը՝ Ավան և Նոր Նորք վարչական շրջանների քննչական բաժնում։
