Առնվազն մեկ տարի է, Հանրապետության նախագահը Սահմանադրությամբ իրեն վերապահված լիազորությունների շրջանակում ներգրավված է Սահմանադրական դատարանի դատավորի թափուր պաշտոնի համալրման նպատակով Ազգային ժողովին Սահմանադրական դատարանի դատավորի թեկնածություն առաջարկելու գործընթացում:

Այս մասին նշվում է Հանրապետության նախագահի աշխատակազմի հաղորդագրության մեջ:

Այդ պատասխանատու գործընթացը Հանրապետության նախագահն իրականացրել է հրապարակային ու ժողովրդավարական գործելաոճով՝ հավատարիմ մնալով իր սահմանադրական լիազորություններին, պահպանելով սահմանադրական նորմերը և ելնելով անաչառության և օբյեկտիվության սկզբունքներից: Հնարավոր թեկնածուների առաջարկներ և հավակնորդների վերաբերյալ կարծիքներ ստանալու նպատակով Հանրապետության նախագահը նախաձեռնել է օրենքին չհակասող մի շարք ընթացակարգեր, հանդիպել երկրի իրավական ոլորտի բազմաթիվ մասնագետների, իրավաբանական համայնքի հեղինակավոր ներկայացուցիչների, այդ թվում՝ գիտական ու փաստաբանական շրջանակների հետ:

Մեկ տարվա ընթացքում, չնայած մի քանի անգամ հայտարարվել է թեկնածուների հայտերի ընդունման մասին, այդուհանդերձ, հավանական թեկնածուների թիվը եղել է շատ սահմանափակ: ՍԴ դատավորի թեկնածուի ընտրությունը փաստորեն սահմանափակվում է տվյալ պաշտոնին համապատասխանող ընդամենը մի քանի անհատ իրավաբանների շրջանակով:

Կարևորելով իրավական համակարգի, այդ թվում՝ Սահմանադրական դատարանի գործունեության արդյունավետությունը, նկատի ունենալով, որ ՍԴ անդամի թեկնածուի ընտրության հարցը չի կարող անվերջանալի գործընթացի վերածվել, դառնալ քաղաքական սակարկությունների կամ շահարկումների առարկա, հենվելով իր և իրավական հանրույթի ներկայացուցիչների, ինչպես նաև ՍԴ դատավորի հավանական թեկնածուների հետ վերջին երկու օրերի ընթացքում ունեցած քննարկումների արդյունքների վրա, Հանրապետության նախագահը առաջարկում է Վահե Գրիգորյանի թեկնածությունը:

Հանրապետության նախագահը հույս ունի, որ, ընտրվելով ՍԴ դատավոր, Վահե Գրիգորյանն իր ավանդը կներդնի Սահմանադրական դատարանի աշխատանքների արդյունավետության բարձրացման, սահմանադրական արդարադատության, օրենքով Բարձր դատարանի դատավորին վերապահված լիազորությունների լիարժեք իրականացման գործում:

Հ. Գ. Հաշվի առնելով անցած մեկ տարվա փորձը, Հանրապետության նախագահն անհրաժեշտ է համարում, որ ապագայում քննարկվի իր իսկ կողմից ՍԴ դատավորի նշանակման հնարավորությունը՝ փոփոխելով գործող ընթացակարգերը՝ նկատի ունենալով Սահմանադրության 138-րդ հոդվածում (Պաշտոնատար անձանց ժամանակավոր նշանակումը) առկա կարգավորումների տրամաբանությունը:
