Քրեական գործի վարույթը կասեցնելու մասին դատարանի որոշումը հանդիսանում է գործն ըստ էության չլուծող դատական ակտ. Գոռ Աբրահամյան

«Որպես հավելում նախորդ գրառման և իբրև պատասխան վերջինիս վերաբերյալ փաստաբան Արամ Վարդևանյանի գեղեցիկ փաթեթավորված, բայց խիստ յուրովի մեկնաբանությունների.
Նախ՝ հստակ ներկայացրել ենք խնդրո առարկայի վերաբերյալ իրավակարգավորումների շրջանակը: Եթե ոմանք դա չեն ընկալում, նշում ենք վերստին: ՀՀ քրեական դատավարության օրենսգրքի 6-րդ հոդվածի 10.1-րդ կետի իմաստով քրեական գործի վարույթը կասեցնելու մասին դատարանի որոշումը հանդիսանում է գործն ըստ էության չլուծող դատական ակտ:
Նույն օրենսգրքի 427-րդ հոդվածի առաջին մասի համաձայն՝ առաջին ատյանի դատարանի` գործն ըստ էության չլուծող դատական ակտն ուժի մեջ է մտնում կայացման պահից: Չնայած այդ հանգամանքին, օրենսգրքի 376.1 հոդվածի 3-րդ կետը սահմանում է, որ առաջին ատյանի դատարանների՝ գործով վարույթը կասեցնելու որոշումները վերաքննության կարգով բողոքարկման ԵՆԹԱԿԱ են:
Երկրորդ՝ եռաստիճան դատական համակարգի կողմից արդեն իսկ իրավական գնահատականի արժանացած խնդիրները դատավարական այս փուլում, սկզբունքորեն հակասելով արդեն իսկ իր կողմից կայացված մեկ այլ դատական ակտի տրամաբանությանը, Սահմանադրական դատարանի քննարկմանը ներկայացնելը կամայական վարքագիծ է, որն արտահայտվում է ապօրինի ու անհիմն դատական ակտով: Իսկ նման ակտը մրցակցային դատավարական այբուբենի կանոնով առնվազն ենթակա է բողոքարկման՝ ստորադաս դատարանին արդեն արդարադատություն իրականացնելուց չհրաժարվելու սահմանադրական պարտավորության կատարմանը վերադարձնելու լեգիտիմ պահանջով:
