«Դատարանի կողմից գործի վարույթը կասեցնելը և ՍԴ դիմելը բողոքարկման ենթակա չէ». սահմանադրագետ

«Հարգելի գործընկերներ,
Քանի որ Երևան քաղաքի ընդհանուր իրավասության դատարանի դատավոր՝ Դ. Գրիգորյանի գործով վարույթի կասեցման և Սահմանադրական դատարանի դիմելու որոշման վերաբերյալ շարունակվում են քննարկումները, ցանկանում եմ պարզաբանել հետևյալը.
1) ՀՀ քրեական դատավարության օրենսգրքի 31-րդ հոդվածի համաձայն՝ Դատարանի նախաձեռնությամբ կարող է քրեական գործով վարույթը կասեցնել և դիմում ներկայացնել ՍԴ: Նման լիազորությունը ուղղակիորեն նախատեսված է ՀՀ Սահմանադրության 169-րդ հոդվածում: Այս լիազորությունը որևէ պահանջ չի նախատեսում դատական նիստի շրջանակներում այն քննարկելու կամ կողմերի կարծիքը հաշվի առնելու: Հետևաբար որևէ ընթացակարգային կամ այլ տեսակի խախտում առկա չէ և չի կարող լինել:
2) Դատարանի կողմից գործի վարույթը կասեցնելը և ՍԴ դիմելը՝ բողոքարկման ենթակա չէ, ուժի մեջ է մտնում ընդունման պահից: Նշվածը պայմանավորված է այն պարզ պատճառով, որ եթե այն բողոքարկման ենթակա լիներ Դատարանը չէր կարող իրացնել ՍԴ դիմելու լիազորությունը, այլ այն հնարավոր կլիներ իրացնել բացառապես Վճռաբեկ դատարանի կողմից, իսկ ՀՀ Սահմանադրությունը այս լիազորությունը նախատեսել է բոլոր դատարանների համար: Նշված լիազորության իրացման առաջնային հիմքը ՀՀ Սահմանադրությունն է, Սահմանադրական դատարանի մասին Սահմանադրական օրենքը, այնուհետև ՀՀ քրեական դատավարության օրենսգիրքը:
3) Դատախազության արձագանքը առ այն, որ պետք է վերաքննիչ բողոք ներկայացվի կասեցնելու որոշման մասով. Դատախազությունը կողմերից առավել շահագրգռվածը պետք է լինի Սահմանադրական դատարան դիմում ներկայացնելու փաստով, քանի որ օրինականության երաշխավորման նկատմամբ ունի Սահմանադրական պարտականություն, իսկ եթե առկա են հիմնավոր կասկածներ ՀՀ քրեական օրենսգրքի 300.1-րդ հոդվածի սահմանադրականության, ինչպես նաև գործառութային անձեռնմխելիության վերաբերյալ, երբ առկա չէ Սահմանադրական դատարանի վերջնական որոշում՝ Դատարանը պարտավոր է դիմել Սահմանադրական դատարան: Շատ կարևոր է ընդգծել, որ այն պարտականություն է, այլ ոչ հայեցողություն:
4) Վերաքննիչ բողոք ներկայացնելը պետք է ունենա հիմք, հիմնավորում և պահանջ: Հիմքի և հիմնավորումների բացակայությունը թեև ակնհայտ է, սակայն հետաքրքիր է պարզել ենթադրյալ պահանջը, օրինակ՝ «խնդրում եմ չպարզել սահմանադրականության հարցը»…: Կարծում եմ պահանջի վերաբերյալ ևս ամեն ինչ սպառիչ և հստակ է»:
