Քննիչները չարաշահել են պաշտոնեական լիազորությունները և կեղծիք կատարել

Օբյեկտիվ, լրիվ և բազմակողմանի նախաքննության նպատակով ՀՀ հատուկ քննչական ծառայություն ուղարկված` պաշտոնատար անձի կողմից պաշտոնեական լիազորությունները չարաշահելու վերաբերյալ քննվող քրեական գործի նախաքննության ընթացքում հայտնաբերվել են նախկինում հիշյալ գործով վարույթն իրականացնող մարմնի պաշտոնատար անձանց կողմից պաշտոնեական լիազո րությունները չարաշահելու և պաշտոնեական կեղծիք կատարելու առերևույթ հանցագործությունների դեպքեր:
Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՔԾ լրատվական ծառայությունից, ՀՀ քննչական կոմիտեի Շիրակի մարզային վարչության քննիչները, շուրջ երկու տարի, քրեական գործով նախաքննության կատարման ընթացքում, անձնական այլ շահագրգռվածությունից ելնելով, քննչական գործողությունները և դատախազի ցուցումները ժամանակին և պատշաճ կարգով չեն կատարել և արհեստականորեն ձգձգել են նախաքննությունը, իսկ նրանցից մեկը Ազատան համայնքի ավագանու նիստերի արձանագրությունների գրանցամատյանը զննելիս դրանում առկա ու տեսանելի ջնջումները և ավագանու ա նդամի՝ նիստերին մասնակցելու վերաբերյալ գրառումները արձանագրության մեջ խեղաթյուրված է ներկայացրել:
ՀՀ քննչական կոմիտեի Շիրակի մարզային վարչության քննիչների կողմից պաշտոնեական լիազորությունները չարաշահելու և պաշտոնեական կեղծիք կատարելու դեպքերի առթիվ ՀՀ հատուկ քննչական ծառայությունում ՀՀ քրեական օրենսգրքի 308-րդ և 314-րդ հոդվածների 1-ին մասերի հատկանիշներով հարուցվել է քրեական գործ և կատարվում է նախաքննություն:
2015 թվականի հոկտեմբերի 9-ին ՀՀ հատուկ քննչական ծառայությունը հաղորդագրություն էր տարածել այն մասին, որ քաղաքացի Կարապետ Ա.-ն հայտնել է, որ Վարդան Ի.-ն, 2008 թվականից աշխատելով Շիրակի մարզի Ազատան համայնքի ղեկավարի պաշտոնում, չարաշահելով իր լիազորությունները, 2009 թվականից մինչ օրս դրամական օգնություններ է հատկացրել համայնքի այն բնակիչներին, ովքեր փաստացի բացակայել են համայնքից, ինչպես նաև թույլ է տվել բազմաթիվ այլ չարաշահումներ, որով էական վնաս է պատճառվել համայնքի շահերին:
Քաղաքացի Կարապետ Ա.-ի հաղորդման հիման վրա՝ պաշտոնատար անձի կողմից պաշտոնեական լիազորությունները չարաշահելու դեպքի առթիվ ՀՀ ոստիկանության ՔԳՎ Շիրակի մարզի քննչական բաժնի Ախուրյանի բաժանմունքում դեռևս 2013 թվականին ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասի հատկանիշներով հարուցվել է քրեական գործ և շուրջ երկու տարի կատարվել նախաքննություն: Այնուհետև տևական ժամանակ քննված հիշյալ քրեական գործը ՀՀ քննչական կոմիտեի Շիրակի մարզային վարչության քննիչի որոշմամբ կարճվել է, սակայն դատախազը վերացրել է քրեական հետապնդում չիրականացնելու և գոր ծով վարույթը կարճելու վերաբերյալ վերջինիս կայացրած որոշումը և ուղարկել լրացուցիչ նախաքննության:
Հետագայում գործի փաստական հանգամանքներով պայմանավորված՝ լրիվ, օբյեկտիվ և բազմակողմանի քննությունը երաշխավորելու անհրաժեշտությունից ելնելով՝ ՀՀ գլխավոր դատախազի կողմից քրեական գործը քննության է ուղարկվել ՀՀ հատուկ քննչական ծառայություն:
