«Փաստ» օրաթերթը շարունակում է ներկայացնել «Ճանաչեք և պաշտպանեք ձեր իրավունքները» խորագիրը: Շատ են դեպքերը, երբ քաղաքացիները չեն կարողանում պաշտպանել իրենց իրավունքները, քանի որ իրազեկված չեն, իսկ երբեմն էլ որոշ պետական հիմնարկներ էլ ավելի են շփոթեցնում նրանց:

Օրաթերթը, համագործակցելով ՀՀ փաստաբանների պալատի հետ, այսուհետ հանրային իրազեկման արշավ է կազմակերպում, որը կօգնի մեր քաղաքացիներին իմանալ և պաշտպանել իրենց իրավունքները: Նշենք նաև, որ յուրաքանչյուր հինգշաբթի՝ ժամը 10:00-ից մինչև 17:00-ն փաստաբանների պալատի հանրային պաշտպանի գրասենյակն անվճար խորհրդատվություն է տրամադրում ՀՀ բոլոր քաղաքացիներին:

Մեր խմբագրությանը հարցով դիմել է Մարտիրոս Սահակյանը (անուն ազգանունը փոփոխված է– խմբ.):

-Երկու օր առաջ ճանապարհային ոստիկանը, կանգնեցնելով մեքենաս, արձանագրեց ամրագոտի չկապելու իրավախախտում և վարչական պատասխանատվության ենթարկեց ինձ: Ես համաձայնեցի նրա հետ, քանի որ մեքենայիս ամրագոտին վնասվել է և հնարավոր չէր այն ամրակապել: Տուգանելուց հետո շարունակեցի վարել մեքենան, 15 րոպե անց մեկ այլ տեսուչ նորից կանգնեցրեց մեքենաս և նորից արձանագրեց նույն խախտումը, ինչի համար 15 րոպե առաջ արդեն տուգանվել էի: Ես նրան բացատրեցի, որ արդեն ենթարկվել եմ պատասխանատվության այդ արարքի համար, և եթե նա ևս խախտումը արձանագրի, կստացվի մի արարքի համար կրկնակի եմ պատասխանատվության ենթարկվում, սակայն նման պնդումը նա հիմք չընդունեց և կրկին ինձ պատասխանատվության ենթարկեց: Իրավունք ունե՞ր երկրորդ տեսուչն ինձ պատասխանատվության ենթարկելու:

Այո, իրավունք ուներ երկրորդ անգամ ևս վարչական պատասխանատվության ենթարկելու: Պատճառն այն է, որ Վարչական իրավախախտումների մասին ՀՀ օրենսգրքի 1233-րդ հոդվածը պատասխանատվություն է սահմանում ոչ թե անվտանգության գոտիները չամրակապելու, այլ այն չամրակապված վիճակում տրանսպորտային միջոցը վարելու համար:

Ամեն անգամ, երբ Դուք ձեր մեքենան վարել եք անվտանգության գոտին չամրակապած վիճակում, Դուք դրանով կատարել եք առանձին իրավախախտումներ: Եվ երբ առաջին տեսուչը Ձեզ վարչական պատասխանատվության է ենթարկել չամրակապած վիճակում մեքենա վարելու համար, Դուք իրավունք չունեիք կրկին վարել՝ անվտանգության գոտին չամրակապած վիճակում: Եվ երբ երկրորդ տեսուչն է Ձեզ վարչական պատասխանատվության ենթարկում նույն հիմքով, դա չի նշանակում, որ նա նույն արարքի համար կրկնակի պատասխանատվության է ենթարկում Ձեզ: Նա արձանագրում է միայն 15 րոպե անց անվտանգության գոտին չամրակապած վիճակում մեքենա վարելը և հենց այդ րոպեին վարելիս ամրագոտի չամրակապելու համար է պատասխանատվության ենթարկում, այլ ոչ թե 15 րոպե առաջվա համար:

Օրենքը պարտադրում է ոչ թե անվտանգության գոտին ընդհանրապես ամրակապել, այլ այն ամրակապել, երբ մեքենան ընթացքի մեջ է, այն վարում եք: Յուրաքանչյուր դեպքում, երբ մեքենան ընթացքի մեջ չէ՝ կանգնած է, դուք չեք կարող պատասխանատվության ենթարկվել անվտանգության գոտին չամրակապելու համար:
