Դատական վերահսկողության գործառույթն իրականացնելիս՝ պաշտոնաթող դատավորը հանդես է գալու որպես դատարան. Արթուր Ղամբարյանի առաջարկը

ՀՀ քննչական կոմիտեի նախագահի նախկին տեղակալ, գործող փաստաբան Արթուր Ղամբարյանը ֆեյսբուքյան իր էջումգրել է.

«ՀՀ քրեական դատարանների գերծանրաբեռնվածությունը համակարգն հասցրել է սիներգետիկական բիֆուրկացիայի աստիճանի, և ամեն մի պատահական (չնչին) գործոն կարող է առաջացնել անկանխատեսելի քաոսային հետևանքներ: Առաջարկվում են լուծման տարբեր կառուցակարգեր, սակայն դեռ խնդիրը առկածված է: Նման պայմաններում պետք են ոչ ստանդարտ և խիզախ մոտեցումներ: Օրինակ՝ անգլիայում մարդու հաղորդակցությանը միջամտելու գործընթացը գտնվում է Հաղորդակցությունը վերահսկող պաշտոնատար անձի (Interception of Communications Commissioner) վերահսկողության ներքո, ով պետք է լինի գործող կամ ՊԱՇՏՈՆԱԹՈՂ ԴԱԸԱՎՈՐ (Барабанов П. К. Уголовный процесс Великобритании. М.: Изд. «Спутник», 2015. С. 503.): Իռլանդիայում ոչ ինտիմ նմուշները հարկադրաբար կարելի է վերցնել խելամիտ ուժ կիրառելով, որի թույլտվությունը տալիս է Garda Siochana Ombudsman Commission հանձնակատարը (Իռլանդիայում գործող անկախ մարմին, որը վերահսկում է Իռլանդիայի ոստիկանության գործունեությունը): Այսպիսով՝ դատական վերահսկողության որոշ ոլորտներ հնարավոր է պատվիրակել պաշտոնաթող դատավորներին:

Առաջարկում եմ քննարկել հաղորդկացության վերահսկման (բացի՝ ՕՀՄ) և բնակարանում խուզարկության նկատմամբ դատական վերահսկողության գործառույթը պաշտոնաթող դատավորներին կամավորության սկզբունքով պատվիրակելու գաղափարը (գործող դատավորը նույնպես կարող է այս գործառույթն իրականացնել): Դատական վերահսկողության գործառույթն իրականացնելիս՝ պաշտոնաթող դատավորը հանդես է գալու որպես դատարան (սա իրավական ֆիկցիա է, ինչպես ԲԴԽ դեպքում է), օգտվելու է դատավորի իրավական անկախության և դատավարական երաշխիքներից, նրա որոշումները բողոքարկվելու է վերաքննիչ դատարան: Նա շարունակելու է ստանալ կենսաթոշակ, բայց ոչ աշխատավարձ: Պաշտոնաթող դատավորին դատական վերահսկողության գործառույթը որոշմամբ պատվիրակելու է ԲԴԽն-ն (ձևակերպումների շուրջ կարելի մտածել):

Այս գաղափարը ԵԿ-ի 8-րդ հոդվածի տեսանկյունից խնդրահարույց չէ, քանի որ պաշտոնաթող դատավորն օգտվելու է անկախության բարձր երաշխիքներից: Քննարկման կարիք ունի պաշտոնաթող դատավորին վերահսկողության գործառույթը պատվիրակելու սահմանադրականության հարցը: Ուստի ցանկալի է լսել հանրային իրավունքի մեր մասնագետների կարծիքը:

Ունենք բազմաթիվ փորձառու պաշտոնաթող դատավորները, ովքեր ունակ են պատշաճ իրականացնելու այս գործառույթը: Նրանց փորձառությունը և հմտությունները մեզ անհրաժեշտ են: 
Այս դեպքում կբարձրանա ոչ միայն դատական վերահսկողության որակը, այլև գործող դատավորները հնարավորություն կունենան բարեխիղճ կերպով իրականացնել արդարադատություն: Նրանք այժմ գերծանրաբեռնվածության պատճառով այս հնարավորությունից փաստացի զրկված են»:
