Համայնքին պատկանող տարածքը վաճառվել է շուկայական արժեքից 18 մլն դրամ պակաս գնով. հարուցվել է քրեական գործ
SOCIETYԵրևան քաղաքի Աջափնյակ և Դավթաշեն վարչական շրջանների դատախազությունում քրեական գործ է հարուցվել դեռևս 2008թ. ՀՀ Երևան քաղաքի Դավթաշեն համայնքում գտնվող համայնքապատկան տարածքը շուկայականից էականորեն ցածր գնով վաճառելու դեպքի առթիվ:
Մասնավորապես, ՀՀ ՔԿ ԵՔՔՎ Աջափնյակ և Դավթաշեն վարչական շրջանների քննչական բաժնում նախապատրաստված նյութերով փաստական տվյալներ են ստացվել այն մասին, որ Երևան քաղաքի Դավթաշեն համայնքի ավագանու 2008թ. սեպտեմբերի 25-ի նիստի որոշման, 2008թ. հոկտեմբերի 6-ի՝ գույքի(օբյեկտի) աճուրդով մասնավորեցման մասին արձանագրության և Դավթաշեն համայնքի ղեկավարի 2008թ. հոկտեմբերի 8-ի որոշման հիման վրա «Տարածքի աճուրդային առուվաճառքի պայմանագրով» Դավթաշեն համայնքի սեփականություն հանդիսացող Դավթաշեն 3-րդ թաղամասի 23/1 շենքի 854.7 քմ մակերեսով հ.7 տարածքը 1 քմ 33.000 ՀՀ դրամով, ընդհանուր՝ 28.205.100 ՀՀ դրամով, օտարվել է մի քաղաքացու:
Նշված տարածքը օտարելուց մոտ մեկ ամիս անց Երևան քաղաքի Դավթաշեն համայնքի ավագանին 2008թ. նոյեմբերի 11-ի նիստում, իսկ Դավթաշեն թաղային համայնքի ղեկավարը 2008թ. նոյեմբերի 17-ին որոշումներ են կայացրել թաղապետարանի աշխատանքները կազմակերպելու նպատակով հիշյալ օտարված տարածքից 381.1 քմ-ն՝ իր մասնաբաժին հողատարածքով, 20.800.000 ՀՀ դրամով, այսինքն՝ 1 քմ՝ 54.578 ՀՀ դրամով հետ գնելու մասին։ 2008թ. նոյեմբերի 18-ին տարածքը գնած քաղաքացու և Դավթաշեն թաղային համայնքի միջև կնքվել է անշարժ գույքի առուվաճառքի պայամանագիր:
Սակայն համայնքի ավագանին 2009թ. մարտին կայացրած համապատասխան որոշմամբ առուվաճառքի ադ պայմանագիրը լուծել է՝ պայմանագրով սահմանված գումարը բյուջեի սղության պատճառով վճարելու անհնարինության հիմքով: Արդյունքում կողմերի միջև կնքվել է պայմանագիրը լուծելու մասին համաձայնագիր։
Փաստորեն, ըստ նախապատրաստված նյութերի, Դավթաշեն համայնքի ավագանու և Դավթաշեն համայնքի ղեկավարի հիշյալ որոշումներով համայնքային սեփականություն հանդիսացող վերոնշյալ տարածքն օտարվել է շուկայականից էականորեն՝ ավելի քան 18.000.000 ՀՀ դրամով պակաս գնով, ինչի արդյունքում առաջացել են ծանր հետևանքներ։
Նկատի ունենալով, որ նյութերի նախապատրաստմամբ ձեռք են բերվել տվյալներ, որ Երևան քաղաքի Դավթաշեն համայնքի ավագանու և համայնքապետարանի իրավասու պաշտոնատար անձինք առերևույթ չարաշահել են իրենց պաշտոնեական լիազորությունները, ինչն անզգուշությամբ առաջացրել է ծանր հետևանքներ` Երևան քաղաքի Աջափնյակ և Դավթաշեն վարչական շրջանների դատախազության դատախազի կողմից հարուցվել է քրեական գործ՝ ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 2-րդ մասի հատկանիշներով:
Քրեական գործի նախաքննությունը հանձնարարվել է ՀՀ ՔԿ ԵՔՔՎ Աջափնյակ և Դավթաշեն վարչական շրջանների քննչական բաժնին:
