Դատարանը մերժել է «Սարի թաղ»-ի գործը կասեցնելու դեմ լրագրողների բողոքը

Այսօր Երևանի ընդհանուր իրավասության դատարանը (Ավան և Նոր Նորք վարչական շրջանների նստավայր) մերժել է «Սարի թաղ»-ի դեպքերով հարուցված քրեական գործը կասեցնելու մասին ՀՔԾ որոշման դեմ ներկայացված՝ տուժող լրագրողների բողոքը։

Հիշեցնենք, 2016 թվականի հուլիսի 29-30-ին Երևանի Սարի թաղում ծավալված իրադարձություններից հետո, երբ քրեական գործ հարուցվեց,  տուժած լրագրողներից 2-ը դիմեցին Խոսքի ազատության պաշտպանության կոմիտե՝ իրենց իրավունքների պաշտպանության համար: ԽԱՊԿ-ի փաստաբանները ներկայացրել են նրանց շահերն իրավապահ մարմինների հետ հարաբերություններում։ Կազմակերպությունը հետևել է գործի ընթացքին՝ մշտապես հարցումներ ուղարկելով ՀՔԾ, ու արձանագրել նախաքննության անարդյունավետությունը:

Այս կապակցությամբ ԽԱՊԿ-ն աջակցել է լրագրողներին՝ բողոքով դիմել  միջազգային ատյաններ: Մի լրագրողների  գործն  ուղարկվել է ՄԱԿ-ի մարդու իրավունքների կոմիտե, մյուսինը ՝ Եվրոպական դատարան: Թեև ՄԱԿ-ի մարդու իրավունքների կոմիտեն կոմունիկացրել էր (շրջանառության մեջ էր դրել) բողոքը, սակայն  ի վերջո հորդորել է նախ  երկրի ներսում սպառել բոլոր հնարավորությունները:

Մինչդեռ, ՀՔԾ-ն, կասեցնելով քրեական գործը, պաշտոնապես հաստատեց իր անգործությունը, իսկ 1-ին ատյանի դատարանն էլ պաշտպանեց քննչական մարմնի որոշումը։

«Վատ որոշում է,- արձագանքելով դատարանի որոշմանը՝ասաց ԽԱՊԿ փաստաբան Կարեն Տոնոյանը։- Գտնում եմ, որ դատարանի կողմից ՀՔԾ-ի կասեցման որոշումը պետք է վերացվեր։ Այն բոլոր նյութերը, որ քննիչը ներկայացրել էր դատարան, ևս հիմնավորում էին, որ իրականացվել է թերի քննություն, որ անհրաժեշտություն կա շարունակելու քննությունը»։
