Դատախազությունը Լևոն Սարգսյանի հայտնաբերման մասին դեռևս չունի տեղեկություններ

ՀՀ դատախազությունը Սերժ Սարգսյանի եղբայր Լևոն Սարգսյանի համար էքստրադիցիոն գործընթաց չի սկսել, քանի որ նրա հայտնաբերման մասին դեռ տեղեկություններ չկան: «Արմենպրես»-ի հաղորդմամբ՝ այս մասին ԱԺ-ում պետաիրավական հարցերի հանձնաժողովի փակ նիստից հետո լրագրողների հետ զրույցում ասաց ՀՀ գլխավոր դատախազ Արթուր Դավթյանը:
«Նրա հայտնաբերման համար դեռևս տեղեկություններ չկան: Էքստրադիցիոն գործընթացը սկսվում է, երբ որ անձը հայտնաբերվում է:Երբ տվյալ երկրի իրավապահ մարմինները հայտնաբերում, մեզ հայտնում են, այդ ժամանակ առաջանում են մեր գործողությունները»,-ասաց Դավթյանը:
Անդրադառնալով դիտարկմանը, թե ԱԱԾ տնօրեն Արթուր Վանեցյանն ասել է, որ Լևոն Սարգսյանն արաբական երկրներից մեկում է, Դավթյանն ասաց՝ իրենք էքստրադիցիոն գործընթաց կարող են սկսել միայն այն դեպքում, երբ մարդուն հայտնաբերում, ձերբակալում են և իրենց դրա մասին պաշտոնապես տեղեկացնում են:
ՀՀ հատուկ քննչական ծառայության վարույթ էր ընդունվել հայտարարագրման ենթակա գույքը թաքցնելու և ապօրինի հարստանալու դեպքերի առթիվ ՀՀ ԿԱ պետական եկամուտների կոմիտեի քննչական վարչությունում հարուցված քրեական գործը: Համաձայն քրեական գործի` պաշտոնատար անձ հանդիսացող Լևոն Սարգսյանը, նրա որդին և դուստրը` Նարեկ և Անի Սարգսյանները, կասկածվում են ՀՀ քրեական օրենսգրքի 310.1-րդ հոդվածի 1-ին մասով (ձեռնարկատիրական գործունեությանն ապօրինի մասնակցելը) և 314.3-րդ հոդվածի 2-րդ մասով (պաշտոնեական կեղծիքը, որը կատարվել է պետական պատասխանատու պաշտոն զբաղեցնող պաշտոնատար անձի կողմից) նախատեսված հանցավոր արարքների կատարման մեջ:
Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքովսահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
