Ռոբերտ Քոչարյանի գործով եւս երկու գանգատ է ուղարկվել ՄԻԵԴ. մեկի հիմքում Փաշինյանի ելույթն է

ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի պաշտպանները եւս երկու գանգատ են ներկայացրել Մարդու իրավունքների եվրոպական դատարան: Այս մասին այսօր՝ մարտի 7–ին, NEWS.am–ի հետ զրույցում ասաց Քոչարյանի փաստաբանական թիմի անդամ Հայկ Ալումյանը։

Ներկայացված գանգատներից մեկը վերաբերվում է երկրորդ նախագահի կալանքի ժամկետը երկարարցնելուն:

Պաշտպանը նշեց, որ չեն սպասել Վճռաբեկի որոշմանը, քանի որ Վճռաբեկ դատարանն, ըստ նրա՝ արդյունավետ միջոց չէ։

Գանգատներից մեկի համար հիմք է հանդիսացել կառավարության նիստի ժամանակ վարչապետ Նիկոլ Փաշինյանի արած արտահայտությունը:

Ըստ Հայկ Ալումյանի՝ նիստի ընթացքում վարչապետի կողմից Կոնվենցիայի 3-րդ հոդվածով արգելված վերաբերմունքի ենթարկելու սպառնալիքներ են հնչել։

2019թ. փետրվարի 21–ի կառավարության նիստում Նիկոլ Փաշինյանը, խոսելով կոռուպցիայի դեմ պայքարի մասին, ասել էր. «ՀՀ ժողովրդից գողացողը պետք է բռնվի, ամբաստանվի, խայտառակվի, բարոյապես ոչնչացվի եւ ուղարկվի բանտ»։

Նշենք, որ մարդու իրավունքների եւ հիմնարար ազատությունների պաշտպանության մասին Եվրոպական կոնվենցիայի 3–րդ հոդվածի համաձայն՝ ոչ ոք չպետք է ենթարկվի խոշտանգումների կամ անմարդկային կամ նվաստացնող վերաբերմունքի կամ պատժի:

«Փաշինյանի հայտարարությունում խոշտանգման մասին խոսք չկա, բայց պարոն Փաշինյանը բացի այն, որ սպառնում է կոռուպցիայի մեջ մեղադրվող անձանց դատել, ուղարկել պատիժը կրելու, այլեւ ըստ նրա՝ այդ անձանց  պետք է խայտառակել, բարոյապես ոչնչացնել եւ ուղարկել բանտ»,–ասաց փաստաբանը՝ նկատելով, որ վարչապետը, բացի օրենքով նախատեսված միջոցներից, պատրաստվում է նաեւ օրենքով չնախատեսված եւ Կոնվենցիայով ուղղակիորեն չարգելված միջոցների դիմել։

Ըստ փաստաբանի՝ վարչապետը նկատի չունի այն մարդկանց, ովքեր  մեղավոր են ճանաչված եւ պատիժ են կրում, այլ նրա խոսքն ուղղված է այն անձանց, ովքեր դեռ կասկածվում կամ մեղադրվում են կոռուպցիայի մեջ։

«Հաշվի առնելով, որ Ռոբերտ Քոչարյանին մեղադրանք է առաջադրվել կաշառքի համար եւ երեւում է, որ Փաշինյանը ուղղորդում է քննությունը, հստակորեն կարող ենք եզրակացնել, որ այդ սպառնալիքը վերաբերվում է կամ առնվազն կարող է վերաբերվել պարոն Քոչարյանին»,–ասաց Ալումյանը։

Հիշեցնենք, որ ավելի վաղ Քոչարյանի պաշտպանական խումբը եւս երկու գանգատ էր ներկայացրել ՄԻԵԴ։ Գանգատներից մեկը ներկայացվել է Եվրոպական կոնվենցիայի 6-րդ հոդվածի 2-րդ եւ 3-րդ կետերով` անմեղության կանխավարկածի եւ պաշտպանության իրավունքի խախտման հիմքերով, իսկ մյուսը՝ Ռոբերտ Քոչարյանի նկատմամբ որպես խափանման միջոց կալանավորման որոշումն ընտրելու հիմքով:

Հիշեցնենք, որ Ռոբերտ Քոչարյանը մեղադրվում է Քրեական օրենսգրքի 300.1-րդ հոդվածի 1-ին մասով եւ 311-րդ հոդվածի 4-րդ մասի 2-րդ մասով` ՀՀ սահմանադրական կարգը տապալելու եւ առանձնապես խոշոր չափերով կաշառք ստանալու մեջ: Նրա, ինչպես նաեւ Մարտի 1-ի գործով մեղադրյալներ Արմեն Գեւորգյանի, Յուրի Խաչատուրովի եւ Սեյրան Օհանյանի վերաբերյալ գործով նախաքննությունն ավարտվել է:
