Իմ նկատմամբ որևէ ճնշում չի եղել. Վերաքննիչ դատարանի նախագահը՝ Քոչարյանի գործի մասին
POLITICSՀՀ վերաքննիչ քրեական դատարանի նախագահ Վազգեն Ռշտունին պնդում է, որ թե նախկին, թե ներկա իշխանությունների օրոք Վերաքննիչ քրեական դատարանում դատական ակտերը կայացվել և կայացվում են առանց ճնշումների: Լրագրողների հետ զրույցում Ռշտունին նշեց, որ իր համար շատ արտասովոր են այն խոսակցությունները, թե, իբր Բաղրամյան, 26-ից (Հայաստանի Հանրապետության վարչապետի նստավայրը- խմբ.) եղել են զանգեր, և իրենք առաջնորդվել են Բաղրամյան 26-ի զանգերով, այսօր էլ իրենց նկատմամբ կան ճնշումներ զանգերի միջոցով:
«Իմ նկատմամբ որեւէ ճնշում չի եղել եւ եթե դատավորների նկատմամբ ճնշումներ լինեին, երեւի թե ես կիմանայի կամ գոնե ինձ կասեին այդ մասին: Կարող եմ պնդել, որ ինձ զանգեր չեն եղել, և այս դատարանում դատավորներն առաջնորդվել բացառապես օրենքով և ղեկավարվել Սահմանադրությամբ: Դատավորին ուղղորդելու, ցուցումներ տալու անհրաժեշտությունն այսօր բացակայում է: Դրա մասին են վկայում հատկապես վերջին տարիներին դատարանների կողմից կայացվող արդարացման դատական ակտերը և, կարծում եմ, դա կարևոր ցուցանիշ է գնահատելու, թե դատարանները ինչքանով են անկախ գործում»,- ընդգծեց Ռշտունին:
Ըստ ՀՀ վերաքննիչ քրեական դատարանի նախագահի` որքան էլ փորձեն դատավորների ազդեցություն գործադրել, որքան էլ ուղղվածություն լինի կամ ցանկություն լինի դատարանների վրա ճնշում գործադրելու, դատավորը չի ճնշվի և չի ուղղորդվի, եթե ունի կամային հատկանիշներ:
«Դատավորի համար կամային հատկանիշները պարտադիր են, քանի որ նա խնդիր ունի ամենօրյա մարդկանց սուր հարցերի հետ։ Հատկապես վերաքննիչ դատարանում այդ հարցերը ավելի են սուր դառնում, քանի որ մարդիկ չգտնելով իրենց հարցերի պատասխանները առաջին ատյանի դատարաններում, այդ հարցը բարձրացնում են նաև վերադաս ատյանում: Եթե դատավորը ի զորու չէ կամ ի վիճակի չէ մարդկանց խնդիրներին լուծում տալու, ղեկավարվելով սահմանադրությամբ և օրենքներով, իհարկե, չկորցնելով իր ներքին համոզմունքն ու խիղճը, այո, նման անձանց նկատմամբ հնարավոր է ճնշում գործադրել կամ նրանց ուղղորդել»,- եզրափակեց Ռշտունին:
