Մեղադրանք է առաջադրվել ՀՀ անշարժ գույքի կադաստրի կոմիտեի աշխատակցին

ՀՀ քննչական կոմիտեի Երեւան քաղաքի քննչական վարչության Մալաթիա-Սեբաստիա վարչական շրջանների քննչական բաժնում քննվող քրեական գործի շրջանակներում ձեռք բերված բավարար ապացույցների համակցությամբ` դատական ակտը դիտավորությամբ չկատարելու համար՝ մեղադրանք է առաջադրվել ՀՀ անշարժ գույքի կադաստրի կոմիտեի Երեւանի տարածքային ստորաբաժանման հաշվառման տվյալների մուտքագրման բաժնի պետին: Նրա նկատմամբ որպես խափանման միջոց է ընտրվել ստորագրությունը չհեռանալու մասին:
ՀՀ Քննչական կոմիտեից հայտնում են, որ քննությամբ ձեռք բերված տվյալների համաձայն՝ քաղաքացին բազմաթիվ անգամներ նամակով դիմել է Անշարժ գույքի կադաստրի կոմիտե՝ հայտնելով, որ Երեւան քաղաքի Հաղթանակ թաղամասում գտնվող իր հողամասերը բնության մեջ եւ էլեկտրոնային քարտեզում գտնվում են տարբեր իրադրական դիրքում: Քաղաքացին պահանջել է հողամասը տեղադրել էլեկտրոնային քարտեզի վրա եւ կատարել ուղղում՝ կադաստրային հատակագծերում /էլեկտրոնային քարտեզում/ պահպանելով գծային չափերը եւ մակերեսը:
Նշված հանգամանքը քաղաքացին վիճարկել է ՀՀ վարչական դատարանում եւ վերջինիս հայցապահանջի հիման վրա՝ ՀՀ վարչական դատարանը 2017 թվականի հուլիսի 7-ին վճիռ է կայացրել, որով ՀՀ ԿԱ անշարժ գույքի կադաստրի պետական կոմիտեին պարտավորեցրել է քաղաքացուն պատկանող հողամասը տեղադրել էլեկտրոնային քարտեզի վրա եւ կատարել ուղղում՝ կադաստրային հատակագծերում պահպանելով գծային չափերը եւ մակերեսը, ինչը, սակայն, կառույցի համապատասխան բաժնի պետի կողմից չի կատարվել:
Ձեռք բերված բավարար ապացույցների համակցությամբ՝ ՀՀ քննչական կոմիտեի ԵՔՔՎ Մալաթիա-Սեբաստիա վարչական շրջանների քննչական բաժնի ՀԿԳ քննիչ Ա. Արմենակյանի կողմից որոշում է կայացվել՝ ՀՀ անշարժ գույքի կադաստրի կոմիտեի Երեւանի տարածքային ստորաբաժանման հաշվառման տվյալների մուտքագրման բաժնի պետին մեղադրանք առաջադրել՝ ՀՀ քրեական օրենսգրքի 353-րդ հոդվածի 1-ին մասով: Նրա նկատմամբ որպես խափանման միջոց է ընտրվել ստորագրությունը չհեռանալու մասին:
