Մհեր Ենոքյանին ներում չի շնորհվել

1996 թվականի հուլիսին բժշկական համալսարանի 19-ամյա ուսանող Իոսիֆ Աղաջանովի սպանության համար ցմահ դատապարտված Մհեր Ենոքյանի խնդրագրին վարչապետ Նիկոլ Փաշինյանը բացասական եզրակացություն է տվել: Այդ մասին «Առաջին լրատվական»-ի հետ զրույցում ասել է ՀՀ արդարադատության նախարար Արտակ Զեյնալյանը:
«Ներման խնդրագիրը բավարարելը կամ մերժելը հայեցողական լիազորություն է և բացատրման պարզաբանման ենթակա չէ»,- նշել է Զեյնալյանը, ապա հավելել, որ մեր հասարակությունը դեռևս պատրաստ չէ վեր կանգնել և առաջնորդվել իրավունքի գերակայության սահմանադրական կատեգորիայով:
«Բոլորը պետք է իմանան, որ ցմահ ազատազրկում պատժաչափը պայմանական է. անձը պետք է մոտիվացված լինի ապրելու և օրինաչափ վարքագիծ դրսևորելու. դա բխում է միջազգային իրավունքից, անձը պետք է իմանա, որ շանս ունի ինչ-որ ժամանակ ազատվելու պատժից. Հայաստանում 20 տարուց հետո ցմահ դատապարտված անձը կարող է հավակնել ներման»,- ասել է Զեյնալյանը:
Հիշեցնենք, որ ՀՀ վարչապետի մամուլի խոսնակ Վլադիմիր Կարապետյանը տեղեկացրել էր, որ Նիկոլ Փաշինյանն օրենքով սահմանված կարգով Մհեր Ենոքյանի ներման խնդրագրի վերաբերյալ իր դիրքորոշումն է ներկայացրել հանրապետության նախագահին:
Ավելի ուշ ներման խնդրի վերաբերյալ հայատարություն էր տարածել նաև հանրապետության նախագահի աշխատակազմի հասարակայնության հետ կապերի վարչությունը՝ հայտնելով, որ հանրապետության նախագահի աշխատակազմը ստացել է մի շարք անձանց ներման խնդրագրերի վերաբերյալ վարչապետի առաջարկությունը, և առանց առարկությունների՝ ստորագրել է հրամանագիրը, որից հետո միայն ներման խնդրագրերի մասին hանրապետության նախագահի կողմից ստորագրված հրամանագիրը ուղարկվել էր արդարադատության նախարարություն:
Հիշեցնենք, որ Մհեր Ենոքյանը մահապատժի էր դատապարտվել 20 տարեկանում՝ 1996 թվականին, համակուրսեցու՝ Իոսիֆ Աղաջանովի սպանության համար /ՀՀ Քր.Օր.-ի 99-րդ հոդվածի 1-ին և 6-րդ կետեր/:
ՀՀ նախագահի՝ 2003 թվականի հրամանագրով՝ ի թիվս 41 մահապատժի դատապարտվածների, պատիժը փոխարինվել է ցմահ ազատազրկմամբ:
