ՍԴ-ն մերժել է Ռոբերտ Քոչարյանի դիմումը՝ Քրեական դատավարության օրենսգրքով բողոքարկման ենթակա որոշումների հոդվածը Սահմանադրության համապատասխանության հարցի քննությունը

Սահմանադրական դատարանի հունվարի 25-ի որոշմամբ մերժվել է Ռոբերտ Քոչարյանի դիմումի հիման վրա քրեական դատավարության օրենսգրքի 414․2-րդ հոդվածի 1-ին մասի 1-ին կետի Սահմանադրությանը համապատասխանության հարցը որոշելու վերաբերյալ գործի քննությունը: Այս մասին հայտնում է Ռոբերտ Քոչարյանի փաստաբանական խումբը:

Հիշեցնենք, որ հունվարի 8-ին ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի փաստաբանական թիմի կողմից առաջին դիմումն էր ներկայացվել Սահմանադրական դատարան:

Սահմանադրական վեճի հիմնական առարկան էր հանդիսանում ՀՀ քրեական դատավարության օրենսգրքի 414․2-րդ հոդվածի 1-ին մասի 1-ին կետով նախատեսված օրենսդրական կարգավորումները, որոնք չեն հստակեցնում, որ Վճռաբեկ դատարանի այդ լիազորությունը որևէ կերպ չի վերաբերում և չի կարող վերաբերել ՀՀ Սահմանադրության նորմերի միատեսակ կիրառության ապահովմանը, քանի որ նշված առարկան կարգավորվում է Սահմանադրական դատարանի կողմից:

Հունվարի 25-ին Սահմանադրական դատարանն աշխատակարգային որոշմամբ անդրադարձել է փաստաբանական խմբի կողմից ներկայացված այդ դիմումին:

Սահմանադրական դատարանի կողմից ընդունված ծավալուն որոշմամբ շեշտվել է, որ Սահմանադրության մեկնաբանության հարցերին վերջնական լուծում տալու լիազորությունը վերապահված է միայն Սահմանադրական դատարանին: Համանման պնդում ներկայացվել էր հենց դիմումի մեջ: Դատարանը նաև ընդգծել է, որ բոլոր դատարանները, այլ ոչ միայն Վճռաբեկ դատարանը, պետք է ինցիդենտ կերպով ստուգեն կիրառվելիք նորմատիվ իրավական ակտի սահմանադրականությունը և պարտավոր են դիմել Սահմանադրական դատարան՝ համապատասխան հիմքերի առկայության դեպքում:

Քանի որ Սահմանադրական դատարանը հատկապես ընդգծել է, որ հենց վերջնական լուծումը սահմանադրական նորմերի մեկնաբանման վերաբերյալ վերապահված է վերջիններիս և այդ գործառույթների բաժանման մոտեցումներն այդ աստիճան հստակությամբ չէին արձանագրվել, թեև դիմումի ընդունելիության մի շարք պահանջները բավարարվել էին՝ դատարանը վարույթ ընդունելը մերժել է:

Պետք է նկատել, որ Սահմանադրական դատարանը բազմիցս հղումներ կատարել է իր իսկ կողմից ընդունված աշխատակարգային որոշումներին և նման ծավալուն աշխատակարգային որոշումը կարող է օգտակար լինել առհասարակ Սահմանադրական դատարան դիմելու գործընթացում: Իսկ տվյալ դեպքում մերժման հիմքը գործնականում հնարավոր է հաղթահարել:

Հիշեցնենք, որ Ռոբերտ Քոչարյանի փաստաբանական թիմի կողմից ՀՀ սահմանադրական դատարան ներկայացվել էին երեք դիմումներ:
