Մենք պնդում ենք, որ Ռոբերտ Քոչարյանին կալանավորելը ոչ իրավաչափ է, անհիմն, և խախտում է Կոնվենցիայի 5-րդ, 6-րդ և 18-րդ հոդվածներով ամրագրված վերջինիս իրավունքները։ Այս մասին Panorama.am-ի հետ զրույցում ասել է երկրորդ նախագահ Ռոբերտ Քոչարյանի փաստաբան, բրիտանացի իրավաբան Էդվարդ Ֆիցջերալդը՝ նշելով, որ այս պահին իրավաբանական թիմը երկու գանգատ է ներկայացրել ՄԻԵԴ։

«Պրն․ Քոչարյանին ուղղված մեղադրանքները անորոշ են և շինծու։ Գրեթե համոզված եմ՝ շուտով կհաստատվի, որ քրեական հետապնդումը և կալանավորումը քաղաքականորեն մոտիվացված են։ Դա շատ կարևոր կլինի ոչ միայն մեր, այլև Հայաստանի ամբողջ հասարակության համար։ Ներկայումս թիմը աշխատում է մեկ ուրիշ գանգատի վրա առ այն, որ պրն. Քոչարյանը արդար դատաքննության բացակայության, այսինքն՝ արդարադատության մերժման զոհ է։ Կան բավարար ապացույցներ, որ իշխանությունները ձախողել են Կոնվենցիայով ամրագրված ընդհանուր և հատուկ երաշխիքների ապահովումը։ Քրեական դատավարությունում խախտումները և երաշխիքների բացակայությունը անկասկած ստեղծում են արդարադատության մերժման մի ամբողջ համակարգ Հայաստանում։

Թույլ տվեք ներկայացնել մի քանի վառ օրինակ։ Նախ, 2018թ.-ի դեկտեմբերին Քոչարյանի գործով Վերաքննիչ դատարանի դատավորի նշանակումը ոչ իրավաչափ էր և բացահայտորեն հակասում էր ներպետական օրենսդրությանը։ Դատավորների վրա ներքին և արտաքին ազդեցություն է գործադրվել (օրինակ` ՀՔԾ-ի և ԱԱԾ-ի ղեկավարների միջև հայտնի հեռախոսային խոսակցությունները)։ Վարչապետ Նիկոլ Փաշինյանի և այլ պաշտոնյաների կողմից արված հայտարարությունները, որոնք խախտում են անմեղության կանխավարկածը։ Նրանք համոզմունք են ձևավորել հասարակության շրջանակներում, որ պրն. Քոչարյանը մեղսագործ է, որն էլ կաշկանդում է դատարանին՝ փաստերը ճիշտ գնահատելու։ Որոշ լրատվամիջոցներ սկսել են ատելություն սերմանող մամլո արշավներ՝ բացասականորեն  ազդելու արդար դատաքննության վրա՝ ձևավորելով հանրային կարծիք և ազդելով Քոչարյանի անմեղության կանխավարկածի վրա։ Եվ այս օրինակները կարելի է շարունակել»,– ասել է փաստաբանը։

Էդվարդ Ֆիցջերալդը վստահ է, որ գործն ունի քաղաքական դրդապատճառներ։

«Վերաքննիչ դատարանը հապճեպորեն հրապարակեց կալանքի որոշումը 2018թ.-ի դեկտեմբերի 7-ին՝ խորհրդարանական ընտրությունների նախօրեին։ Պրն. Քոչարյանը կալանավորվել է անորոշ և շինծու մեղադրանքների հիման վրա, իսկ նրա կալանավորման ժամկետը երկարաձգվել է՝ ակնհայտորեն վերջինս պատժելու նպատակով (այս համատեքստում է օգտագործվում վենդետա հասկացությունը) և կանխելու նրա մասնակցությունը որևէ քաղաքական գործընթացներին։ Իշխանությունները նաև ճնշում են գործադրում մարդկանց վրա` փորձելով ձեռք բերել ապացույցներ, որոնք կարող են հետագայում օգատագործվել Քոչարյանի դեմ։

Ակներև է, որ նախագահը զրկվել է ազատությունից քաղաքական դրդապատճառով։ Դատախազությունը և քննչական մարմիններն իրենք էլ գործում են չբացահայտված բայց ենթադրելի մոտիվներով։ Եվ վերջապես, կա հստակ ապացույց, որ առնվազն այս գործում դատարանները գործադիր իշխանությունից բավարար կերպով անկախ չեն գործել»,– ասել է նա։
