Քննության են առնվում բազմապիսի նոր դրվագներ․ գլխավոր դատախազը՝ Մանվել Գրիգորյանի մեղադրանքը լրացնելու մասին
SOCIETYՇատ սխալ, անընդունելի մեկնաբանություն է․ այսօր՝ հունվարի 28-ին, լրագրողների հետ զրույցում ասաց ՀՀ գլխավոր դատախազ՝ անդրադառնալով Մանվել Գրիգորյանի պաշտպանի հայտարարությանը, թե գլխավոր դատախազը իջնում և ցուցարարներին անձամբ ասում է, որ համամիտ է իրենց տեսակետին։
«Դատախազությունը տվյալ իրավիճակում մեղադրանքի կողմ է հանդես գալիս, ինքն իր ունեցած հիմքերով ներկայացրել է բողոք, այնպես որ այդտեղ կողմնակալ դիրքորոշում ներկայացնելու կամ հրապարակման ոչ ենթակա տեղեկություն ներկայացնելու մասին խոսք լինել չի կարող: Դատախազը ինքն անձամբ արդեն այդ քննարկման մասնակից է և որոշել է, որ բողոքարկվելու է, այսինքն՝ գործ ունենք անհիմն, անօրինական դատական ակտի հետ։ Ինչ տարբերություն՝ փոխանցվում է դատախազի խոսքը, թե դատախազն է փոխանցում։ Եթե կհիշեք, հավաքված քաղաքացիները իրենք էին ուզում, որ անպայման գլխավոր դատախազից լսեն, իսկ գլխավոր դատախազի իջնելու նպատակը, նրա ամենակարևոր ուղերձը, որ պիտի հնչեր մեր քաղաքացիներին այն էր, որ մենք գործ ունենք իրավական գործընթացների հետ, և իմ խնդրանք-հորդորն էր մեր քաղաքացիներին, որ չձեռնարկեն այնպիսի գործողություններ, որոնք կարող էին դիտարկվել որպես ճնշում արդարադատության վրա»,- ասաց Արթուր Դավթյանը:
Մանվել Գրիոգրյանի մեղադրանքի լրացման առնչությամբ գլխավոր դատախազը հիշեցրեց, որ
քրեական գործի հարուցումից ընդամենը երեք օր հետո եղել է որոշակի մեղադրանք, եւ քանի որ քննությունն արդեն յոթ-ութ ամիս ընթանում է, նաեւ հանրային հրապարակումներ են եղել, որ բացի այդ առաջին օրվա մեղադրանքի ծավալից՝ քննության են առնվում բազմապիսի նոր դրվագներ, ասաց՝ «ակնհայտ է, որ այդ դրվագներից, որոնցով ձեռք կբերվեն բավարար ապացույցներ, մեղադրանքը լրացվելու է։ Քրեական գործերով ճնշող մեծամասնության դեպքերում սկզբնական և ավարտական փուլերում մեղադրանքները տարբերվում են»:
Թե ինչ լրացումներ են արվելու, Արթուր Դավթյանը, ասաց, առայժմ չի կարող պատասխանել․
«քննությունը դեռևս չի ավարտվել, եւ կան դրվագներ, որոնցով բավարար չափով ապացույցներ կան, կան դրվագներ, որոնցով դեռ քննությունն ընթանում է, և ապացույցների ծավալը պետք է մեզ թույլ տա՝ որոշելու՝ փոխելու ենք, թե՞ չենք փոխելու»,- նշեց նա:
Իսկ այն լուրերին, թե իրեն փոխարինելու են, Արթուր Դավթյանը պատասխանեց. «Ինձ թվում է՝ լուրջ հարցերը ավարտվեցին»:
