Դատարանը բավարարել է Ռոբերտ Քոչարյանի հերքման պահանջը
SOCIETYՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանն ընդդեմ «Սկիզբ Մեդիա Կենտրոն» ՍՊ ընկերության գործով՝ դատարանը, հերքման մասով հայցվորի ներկայացրած պահանջը բավարավել է ամբողջությամբ: Այս մասին հայտնում են Ռոբերտ Քոչարյանի պաշտպանական խմբից։
«Այսպիսով, Երևան քաղաղի ընդհանուր իրավասության դատարանը՝ նախագահությամբ դատավոր Սարգիս Երիցյանի, բավարարել է և պարտավորեցրել է www.1in.am լրատվական կայքում Ռոբերտ Քոչարյանի վերաբերյալ հրապարակված չորս հոդվածներում տեղ գտած տեղեկությունների վերաբերյալ հերքում հրապարկել այն մասին, որ հիշյալ հոդվածներում Ռոբերտ Քոչարյանի վերաբերյալ տեղեկատվությունները իրականությանը չի համապատասխանում և զրպարտություն է:
Հայցել Ռոբերտ Քոչարյանի ներողամտությունը վերջինիս վերաբերյալ զրպարտություն պարունակող տեղեկատվություններ հրապարակելու և տարածելու, ինչպես նաև նրա պատիվը և արժանապատվությունը արատավորելու համար:
Միևնույն ժամանակ դատարանը նշել է, որ հերքում պետք է հրապարկվի վճիռն օրինական ուժ ստանալուց հետո երկու օրվա ընթացքում՝ առավոտյան ժամը 09:00-ին սահմաններում, իսկ վճիռն օրինական ուժի մեջ կմտնի հրապարակման պահից մեկ ամիս հետո»,- ասված է տարածած հաղորդագրության մեջ։
Դատարանը մասնակի բավարարել է նաև հայցվոր կողմի ներկայացրած զրպարտության դիմաց փոխհատուցման վերաբերյալ 2.000.000 դրամի չափով պահանջից՝ 400 000 ՀՀ դրամը:
Հիշեցնենք, որ Ռոբերտ Քոչարյանի ներկայացուցիչ Անի Ալավերդյանը հայց էր ներկայացրել դատարան, մասնավորապես նշելով, որ 2018թ հունիս ամսին «Սկիզբ Մեդիա Կենտրոն» ընկերությունը հրապարակել է տարբեր հոդվածներ, որոնցում արատավորել է հայցվորի պատիվը և արժանապատվությունը, մասնավորապես` 2018 թվականի հունիսի 7-ին ընկերությանը պատկանող «www.1in.am» ինտերնետային կայքում և «ժամանակ» օրաթերթում հրապարակվել են հոդվածներ` «Գրիգոր Գրիգորյանը ցուցմունք է տվել Քոչարյանի դեմ, վերջինս կարող է կալանավորվել», 23.06.2018 թվականին՝ «Ռոբերտ Քոչարյանի խուճապը, երկրորդ նախագահը` բանտի ճանապարհին», 24.06.2018 թվականին՝ «Հակահեղափոխության արյունոտ սիմվոլը` Ռոբերտ Քոչարյան» և 28.06.2018 թվականին՝ «Քոչարյան-Սարգսյան Արյունոտ քսանամյակի շահառուները» վերնագրերով:
Հայցվորի ներկայացուցիչը նշել էր, որ հոդվածներում ներկայացված փաստերն ամբողջությամբ չեն համապատասխանում իրականությանը և դատարանին խնդրել էր պարտավորեցնել «Սկիզբ Մեդիա Կենտրոն» ՍՊ ընկերությանը հրապարակայնորեն հերքել զրպարտություն համարվող փաստացի տվյալները և պարտավորեցնել ընկերությանը զրպարտության դիմաց Ռոբերտ Քոչարյանին վճարել փոխհատուցում:
