2018-ի դեկտեմբերին անվավեր է ճանաչվել ՀԴՄ ստուգման 198 ակտ. ՊԵԿ
SOCIETYՊետական եկամուտների կոմիտեն շարունակում է վարչարարության բարելավմանն ուղղված քայլերը:
ՊԵԿ-ից հայտնում են, որ այդ միջոցառումների շրջանակում 2018 թվականի դեկտեմբեր ամսվա ընթացքում ՊԵԿ նախաձեռնությամբ անվավեր է ճանաչվել ՀԴՄ ստուգման 198 ակտ (70 493 863 դրամի չափով), ներկայացվել է միջնորդություն դատական գործերը կարճելու մասին: Անվավեր է ճանաչվել նաեւ 16 չգրանցված աշխատողի ստուգման ակտ (60 914 000 ՀՀ դրամի չափով): Հիմքում դրվել են ՀՀ վարչական դատարանի մեկնաբանությունները նույնական հանգամանքներով մի շարք գործերով:
Ստուգման ընթացքում հսկողության արդյունավետությունը բարձրացնելու, կրկնվող սխալները բացառելու մասով համալիր հարկային ստուգման ակտերի շարունակական ուսումնասիրության հիման վրա ներկայացվել են առաջարկներ ստուգում իրականացնող ստորաբաժանումներին, որոնք վերաբերում են ինչպես ընթացակարգային խախտումներին, այնպես հարկային օրենսդրության մեկնաբանություններին, ներկայացվել են զեկուցագրեր դատարանում վիճարկվող որոշ ակտեր անվավեր ճանաչելու առաջարկության մասին առանց ուղեկցող փաստաթղթերի ապրանքների մատակարարման, ապօրինի ձեռնարկատիրության եւ օպերատիվ-հետախուզական գործունեության միջոցով բացահայտվող հարկային իրավախախտումների մասով վարչական վարույթ իրականացնելու լիազորությունը ՕՀՎ վարչությունից փոխանցվել է իրավաբանական վարչությանը:
Դրա արդյունքում բազմաթիվ դեպքերով կարճվել են վարույթները եւ հարկ վճարողներ չեն տուգանվել (2018 թվականի օգոստոսից-դեկտեմբեր ժամանակահատվածում կարճվել է 27 վարույթ, որոնցով առաջադրվելիք տուգանքների հանրագումարը կազմում է 25 570 250 դրամ):
Դատական որոշ ակտեր, ինչպես նաեւ դրանց հիմքում ընկած մի շարք փորձագիտական եզրակացություններ, մտահոգիչ են, քանի որ ակնհայտորեն հակասում են հարկային օրենսդրության կարգավորումներին եւ էությանը: Ներկայացվել են վերաքննիչ եւ վճռաբեկ բողոքներ, նմանատիպ դեպքերով կատարվում են ուսումնասիրություններ:
