ՄԻՊ-ի աջակցությամբ քաղաքացու բանկային հաշիվների վրա դրված արգելանքները վերացվել են

Քաղաքացին դիմել է Մարդու իրավունքների պաշտպանի աջակցությանն իր բանկային հաշիվների վրա դրված արգելանքները վերացնելու համար:

Դիմումատուի փոխանցմամբ՝ իր կինը Հայաստանի բանկերից մեկից վարկով գումար է վերցրել, որը ժամանակին վճարել չի կարողացել:

Արդյունքում, վարկային պարտավորությունները պատշաճ չկատարելու համար տվյալ  բանկը կնոջ դեմ հայց է ներկայացրել դատարան: Կայացված վճռի հիման վրա Հարկադիր կատարումն ապահովող ծառայությունում հարուցվել է կատարողական վարույթ եւ քանի որ կնոջ անունով որեւէ անշարժ գույք կամ դրամական միջոց չի հայտնաբերվել, բռնագանձում է տարածվել իր աշխատավարձի վրա ամբողջությամբ, իսկ մյուս բանկային հաշիվների վրա արգելանք է դրվել:

Քաղաքացու դիմումի հիման վրա աշխատավարձի բռնագանձումը դադարեցվել է, սակայն մյուս հաշիվների վրա դրված արգելանքները պահպանվել են:

Բողոք ներկայացրած անձի պնդմամբ՝ կինը բաժնային սեփականության իրավունքով իրեն պատկանող հողամաս ունի, ուստի բարձրացրել է նշված հողամասում կնոջ ունեցած բաժնեմասի վրա բռնագանձում տարածելու, եւ իր դրամական միջոցների վրա կիրառված արգելանքները վերացնելու հարցերը։

Բողոքի հիման վրա Պաշտպանի աշխատակազմում սկսվել է քննարկման ընթացակարգ, գրություններ են ուղարկվել իրավասու պետական մարմիններին, ստացվել են համապատասխան պարզաբանումներ: Հարկադիր կատարումն ապահովող ծառայության հետ արդյունավետ համագործակցության արդյունքում դիմումատուի բանկային հաշիվների վրա դրված արգելանքները վերացվել են:
