Ներկայացվել են Ռոբերտ Քոչարյանի գործով դատավորի ինքնաբացարկի պատճառները

ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի պաշտպանական խումբը ֆեյսբուքյան էջում հաղորդագրություն է տարածել, որտեղ ներկայացրել է, թե որոնք են դատավոր Նելլի Բաղդասարյանի ինքնաբացարկի պատճառները: Հաղորդագրության մեջ ասված է. «ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի նկատմամբ խափանման միջոց ընտրված կալանավորումն այլընտրանքային խափանման միջոց գրավով փոխարինելու վերաբերյալ գործով դատավոր Նելլի Բաղդասարյանը բավարարել է ինքնաբացարկ հայտնելու միջնորդությունը, որը ներկայացվել էր դատախազների և քննիչի կողմից:

Դատարանի որոշումն այսօր տրամադրվել է Ռոբերտ Քոչարյանի պաշտպանական խմբին:

Որոշման հիմքում դատարանը դրել է այն, որ Ռոբերտ Քոչարյանին և «Մարտի 1»֊ի գործով քննչական խմբի նախկին ղեկավար Վահագն Հարությունյանին մեղադրանքներ են առաջադրվել միևնույն գործի շրջանակներում և քանի որ դատավոր Բաղդասարյանը նախկինում Վահագն Հարությունյանի գործով ինքնաբացարկ է հայտնել, ապա պետք է ինքնաբացարկ հայտնի նաև Ռոբերտ Քոչարյանի խափանման միջոցի մասով:

Միևնույն ժամանակ որոշման մեջ նշվում է, որ այդ հանգամանքների առկայությունը չի խոչընդոտում նախագահող դատավորին՝ գործով անկողմնակալ լինելու առումով, սակայն հաշվի առնելով, որ դրանք արդեն իսկ ողջամիտ կասկած են հարուցել տվյալ նախագահող դատավորի անկողմնակալության մեջ /այդպիսի կասկած հայտնել են միայն դատախազները և քննիչը/, ուստի այդ հանգամանքների առկայության պայմաններում միջնորդության քննության արդյունքում կայացած ցանկացած որոշում (բավարարման կամ մերժման) անկողմնակալ դիտորդի մոտ կարող է կասկած հարուցել դատավորի անկողմնակալության և անաչառության մեջ:

Դատավոր Բաղդասարյանը գտել է նաև, որ իր կողմից ինքնաբացարկ հայտնելն ու միջնորդությունն այլ դատավորի վարույթ փոխանցելը չի կարող հանգեցնել որևէ բացասական հետևանքի»:
