Վիճարկվում են համաներման մասին օրենքի դրույթներ․ Պաշտպանը դիմել է Սահմանադրական դատարան
SOCIETYՄարդու իրավունքների պաշտպանին հասցեագրված բողոքի ուսումնասիրությունը ցույց է տվել, որ համաներման մասին օրենքում բացակայում են կարգավորումներ, որոնք հստակ կամրագրեն համաներման ակտի կիրառման հիմքերը եւ կատարման համար պատասխանատու դատական մարմնի իրավասությունն այն դեպքերում, երբ դատական ակտը բողոքարկվել է վերադաս ատյան, սակայն վերջինիս կողմից դեռեւս չի որոշվել վարույթ ընդունելու հարցը:
Այս առնչությամբ, ՄԻՊ-ի գրասենյակի տարածած հաղորդագրության մեջ նաեւ նվում է.
«Արդյունքում, թե՛ Վերաքննիչ եւ թե՛ Վճռաբեկ դատարանները հնարավորություն չեն ունենում կիրառել համաներում եւ անձին ազատել պատժից:
Ստացվում է, որ վերջնական դատական ակտի բացակայության պայմաններում եւ նույն հանցանքի կատարման մեջ մեղադրվող անձը մի դեպքում կարող է ամբողջությամբ ազատվել պատժից, իսկ մեկ այլ դեպքում՝ նշանակված պատժաչափը համաներման արդյունքում կրճատվել:
Ըստ այդմ, Պաշտպանը դիմել է Սահմանադրական դատարան՝ արձանագրելով, որ նշվածն առաջացնում է օրենքի առջեւ ընդհանուր հավասարության եւ խտրականության արգելքի խախտում, ինչպես նաեւ հակասում է Սահմանադրության՝ որոշակիության, հիմնական իրավունքները եւ ազատությունները կարգավորելիս այդ իրավունքների եւ ազատությունների արդյունավետ իրականացման համար օրենքներով անհրաժեշտ կազմակերպական կառուցակարգեր եւ ընթացակարգեր սահմանելու, հիմնական իրավունքների եւ ազատությունների վերաբերյալ դրույթների էության անխախտելիության, ինչպես նաեւ հիմնական իրավունքների եւ ազատությունների վերաբերյալ Սահմանադրությամբ ամրագրված դրույթները մեկնաբանելիս ՀՀ վավերացրած՝ մարդու իրավունքների վերաբերյալ միջազգային պայմանագրերի հիման վրա գործող մարմինների պրակտիկան հաշվի առնելու սահմանադրական սկզբունքներին:
