ՀՀ քննչական կոմիտեի Գեղարքունիքի մարզային քննչական վարչությունում քննվող քրեական գործով մեղադրանք է առաջադրվել Գեղարքունիքի մարզի բնակչին՝ սպանության փորձ կատարելու համար:  

Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ քննչական կոմիտեի դեպարտամենտի տեղեկատվության և հասարակայնության հետ կապերի բաժնից, 2018թ. նոյեմբերի 15-ին՝ ժամը 05:30-ին, Մարտունի քաղաքի բժշկական կենտրոն է տեղափոխվել նույն քաղաքի՝ 1983թ. ծնված բնակիչը՝ «որովայնի թափանցող վերք մեծ ճարպոնի արտամղմամբ, կրծքավանդակի շրջանի կտրած-ծակած արյունահոսող, ձախ ճաճանչդաստակային հոդի շրջանի, ձախ բազկի միջին 1/3-ի կտրած արյունահոսող վերքեր» ախտորոշմամբ:

Դեպքի առթիվ Գեղարքունիքի մարզային քննչական վարչությունում 2018թ. նոյեմբերի 15-ին հարուցվել է քրեական գործ՝ ՀՀ քրեական օրենսգրքի 34-104-րդ հոդվածի 1-ին մասով: 1983թ. ծնված տղամարդը ճանաչվել է տուժող:

Ձեռնարկված մեծածավալ քննչական և դատավարական այլ գործողությունների արդյունքում պարզվել են դեպքի մի շարք հանգամանքներ՝ դեպքի վայրը, առերևույթ հանցագործություն կատարած անձի իքնությունը, ով հանդիսանում է նույն մարզի բնակիչ՝ ծնված 1975   թվականին:

Օպերատիվ-հետախուզական միջոցառումների արդյունքում նա հայտնաբերվել է և հարցաքննվել դեպքի շուրջ: Վերջինիս մասնակցությամբ կատարվել է քննչական փորձարարություն:

Նախաքննության ընթացքում, օրենքով սահմանված կարգով, կատարվել են խուզարկություններ ենթադրյալ հանցագործություն կատարած անձի բնակության վայրում և ավտոմեքենայում, որի ժամանակ հայտնաբերվել և առգրավվել են դանակներ և ապակյա տարաներով կանաչավուն զանգված, պլաստմասե շիշ՝ պոլիէթիլենային տոպրակով փաթաթված կանաչավուն զանգվածով, թղթե արկղով կանաչավուն զանգված, կտորե պարկով բույսի ցողուններ և մանրացված  կանաչավուն զանգված, հայտնաբերվել են նաև ապակյա կաթուցիչներ, որոնց մեջ առկա են գորշավուն գույնի զանգված:

Ձեռք բերված ապացույցների հիման վրա՝ 43-ամյա տղամարդուն մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 34-104-րդ հոդվածի 1-ին մասով:

Քրեական գործով էական նշանակություն ունեցող հանգամանքներ պարզելու նպատակով նշանակվել են դատաբժշկական, դատաքիմիական, դատաբուսաբանական և դատագենետիկական փորձաքննություններ:

Քննիչը միջնորդություն է ներկայացրել դատարան՝ 1975թ. ծնված տղամարդու նկատմամբ որպես խափանման միջոց կալանավորում կիրառելու վերաբերյալ, ինչը բավարարվել է:

Նախաքննությունը շարունակվում է:

Ձեռնարկվում են անհետաձգելի քննչական և դատավարական այլ միջոցառումներ՝ դեպքի բոլոր հանգամանքները պարզելու, օբյեկտիվ, լրիվ և բազմակողմանի քննությունն ապահովելու ուղղությամբ:

 

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
