Բարձրագույն դատական խորհրդի նախագահ Գագիկ Հարությունյանի խոսքով՝ Սահմանադրությունը հնարավորություն էր տալիս Ազգային ժողովն արձակել առանց երկու անգամ վարչապետ չընտրելու:

«Ավելի խորը սահմանադրությունն ուսումնասիրելու դեպքում անպայման հարց կառաջանար՝ ինչու որոշ հոդվածների փոփոխությունը թողնվեց խորհրդարանին, որպեսզի հնարավոր լիներ ավելի հեշտացնել այսպիսի իրավիճակներում իրավաչափ ելքերը: Խորհրդարանը կարող էր իր կամ կառավարության, կամ էլ 150 հազար քաղաքացիների նախաձեռնությամբ փոփոխություն կատարել 92 հոդվածում, դա թողնված է խորհրդարանին: Եվ ավելացներ նաև այն դրույթը, որ եթե իրավիճակն այնպիսին է, որ անհնար է ձևավորել կայուն մեծամասնություն, նույնպես ԱԺ-ն արձակվում է»,- Սահմանադրական դատարանում տեղի ունեցած «Նոր հազարամյակի սահմանադրականությունը» թեմայով միջազգային խորհրդաժողովից առաջ լրագրողների հետ զրույցում ասաց ԲԴԽ նախագահը:

Ըստ նրա՝ և՛ Սահմանադրության փոփոխությունը, և՛ վարչապետ չընտրելով ԱԺ-ի արձակումը քաղաքակիրթ և սահմանադրական ճանապարհներ են:

Գագիկ Հարությունյանը նշեց, որ եթե խորհրդարանում չի լինում կայուն մեծամասնություն, դա վկայում է սահմանադրական հավասարակշռության խախտման մասին, ինչն էլ կարող է բերել լուրջ սահմանադրական ճգնաժամի:

«Խաթարվում է իշխանության բոլոր թևերի միջև սահմանադրորեն նախատեսված հավասարակշռությունը: Եթե առաջնային մանդատ ունեցող մարմինն ի վիճակի չէ դա շտկելու, պետք է դիմի իշխանություն կրողին՝ ժողովրդին և ժողովուրդն այս պայմաններում պետք է ձևավորի նոր խորհրդարան՝ կայուն խորհրդարանական մեծամասնությամբ, որը կայուն զարգացման երաշխիքն է:

 
 

Այսինքն, եթե անհնարին է խորհրդարանի ներսում կայուն մեծամասնության երաշխավորումն, ապա անխուսափելի են դառնում արտահերթ խոհրդարանական ընտրությունները: Իսկ սահմանադրությունը նախատեսել է՝ ինչ ճանապարհով պետք է տեղի ունենան արտահերթ ընտրությունները»,- ասաց նա։ 

Հիշեցնենք, որ Ազգային ժողովն այսօր երկրորդ անգամ Նիկոլ Փաշինյանին չընտրեցվարչապետի պաշտոնում, ինչի արդյունքում խորհրդարանը կարձակվի իրավունքի ուժով։
