Կրոնական կազմակերպությունների մոտ հավաքները չեն արգելվի. Կառավարությունը մերժեց ՀՀԿ-ականին
SOCIETYՀՀ կառավարությունն իր այսօրվա՝ հոկտեմբերի 25ժ-ի նիստում բացասական եզարակացություն տվեց ԱԺ ՀՀԿ խմբակցության պատգամավոր Միհրան Կահոբյանի օրենսդրական նախաձեռնությանը, որով առաջարկվում է արգելել կրոնական կազմակերպությունների տարածքում հավաքների անցկացումը:
Օրինագիծը ներկայացրեց արդարադատության նախարարի պաշտոնակատար Արտակ Զեյնալյանը:
Նա նշեց, որ նախագծի հեղինակն առաջարկում է փոփոխություն կատարել «Հավաքների ազատության մասին» օրենքում եւ հավաքն արգելելու հիմք նախատեսել նաեւ կրոնական կազմակերպություններին սեփականության կամ վարձակալության իրավունքով պատկանող տարածքներում՝ առանց այդ կազմակերպությունների համաձայնության հավաք անցկացնելը՝ առաջարկվող փոփոխությունը հիմնավորելով կրոնական անհանդուրժողականության վերացման եւ հասարակական կարգի պահպանության անհրաժեշտությամբ:
Զեյնալյանը նշեց, որ ՄԻԵԴ-ի նախադեպային որոշումներից, ինչպես նաեւ ԵԱՀԿ/ԺՀՄԻԳ ուղենիշներից հավաքների արգելումը կարող է արդարացված համարվել միայն այն դեպքում, երբ ակտա են ապացույցներ, որ հավաքի մասնակիցները կարող են իրականացնել անօրինական գործողություններ եւ կա նման գործողությունների հավանականություն:
«Ինչ վերաբերում է կրոնական անհանդուրժողականության վերացման նպատակով հավաքի անցկացման արգելքին, ապա «Հավաքների ազատության մասին» օրենքի 19-րդ հոդվածով այն նախատեսված է որպես հավաքն արգելելու հիմք: Այսպես՝ հավաքն արգելվում է, եթե հավաքի նպատակը կրոնական ատելություն բորբոքելն է:
Միաժամանակ, հարկ է նշել, որ Հայաստանում գրեթե բոլոր եկեղեցիները ներառված են «ՀՀ պետական սեփականություն համարվող եւ օտարման ոչ ենթակա պատմության եւ մշակույթի անշարժ հուշարձանների պետական ցուցակը հաստատելու մասին» կառավարության որոշմամբ հաստատված ցանկում, որոնց տարածքում կամ դրանց անմիջական հարեւանությամբ անցկացվելիք հավաքի նկատմամբ առանձին սահմանափակումներ կիրառելու կամ այն արգելելու վերաբերյալ դրույթներ են նախատեսված «Հավաքների ազատության մասին» օրենքի 17-րդ հոդվածով:
Ելնելով վերոգրյալից գտնում ենք, որ նախագծի ընդունման անհրաժեշտությունը բացակայում է եւ առաջարկվում է գործող օրենքի փոփոխվող հոդվածը թողնել անփոփոխ»,-ասաց նա:
