«Մեր ունեցած ժամանակը շատ կարճ է, և ինձ դա է մտահոգում»
SOCIETYՄիջազգային իրավունքի մասնագետ, իրավաբան Արա Ղազարյանը, ով զբաղվում է մարդու իրավունքների պաշտպանության հարցերով, թեև դեռևս չի հասցրել մանրամասն ծանոթանալ «Ընտրական օրենսգրքի» փոփոխություններինախագծին, բայց կարծում է, որ անգամ նախագծի լավագույն տարբերակը մշակելուց բացի, առաջին և ամենակարևոր պայմանը անթերի ընտրություններկազմակերպելը պետք է լինի:
«Ինչպես Եվրոպական կոնվենցիայում է սահմանված, պետք է կարողանանք ընտրողի կամքի ազատ արտահայտման հնարավորությունն ապահովել: Դրա համար և՛ ժամանակ է պետք, և՛ հստակ ընթացակարգեր են անհրաժեշտ: Բայց մեր ունեցած ժամանակը շատ կարճ է, և ինձ դա է մտահոգում»,- Past.am-ի հետ զրույցում ասաց Արա Ղազարյանը:
Իրավաբանի կարծիքով՝ անկաշկանդ ընտրությունը միայն ընտրության անցկացման օրվան չի վերաբերում, այլ ներառում է նաև դրան նախորդող մեկ կամ երկու ամիս ժամանակահատվածում տեղի ունեցող գործընթացները, ինչը նույնպես կարևոր է:
«Խնդիրն այն չէ, որ ընտրության օրը լցոնումներ չլինեն և դրանով ընտրողների կամքի վրա ազդեցություն չլինի: Նկատի ունեմ՝ բոլոր քաղաքական կուսակցությունների համար պետք է նախապատրաստվելու հավասար պայմաններ ապահովել: Այստեղ հարց է ծագում, որ եթե ընտրություններն անցկացվեն դեկտեմբերի կեսերին, ապա կուսակցություններն արդյո՞ք բավարար ժամանակ կունենան, որպեսզի ծրագրեր մշակեն, այն ներկայացնեն հասարակությանը, հանրության հետ քննարկումներ կազմակերպեն իրենց ծրագրերի շուրջ, մասնակցեն հեռուստաբանավեճերի և այլն: Այս ամբողջը ընտրողի կամքի ազատ ձևավորման հնարավորության մասն է կազմում: Եվ հարց է ծագում, թե արդյո՞ք այս կարճ ժամանակահատվածում հասարակությունը պատրաստ կլինի մասնակցել համապետական նման մեծ միջոցառման: Սա է խնդրահարույց այն հարցը, որն անհանգստացնում է ինձ»,- ասաց Ա. Ղազարյանը:
Նրա դիտարկմամբ, երբ եվրոպական կառույցների ներկայացուցիչներն ասում են, որ Հայաստանում ընտրությունները լավ չեն կազմակերպվում, նկատի են ունենում նաև այդամենը: Միջազգային կառույցներնուշադրություն են դարձնում նաև ընդդիմադիր քաղաքական ուժերին տրված հնարավորությունների վրա, որպեսզի այն որևէ կերպ չսահմանափակվի:
«Հիմա, իհարկե, նման սահմանափակումներ չեն լինի: Եթե մենք ուզում ենք նման կարճ ժամանակահատվածում ընտրություն կազմակերպել, ապա պետք է բավականին զգոն լինենք: Ինչ վերաբերում է լավ ընտրություն անցկացնելու քաղաքական կամքին, դա միանշանակ կա, բայց ինձ անհանգստացնում է, որ ընտրություններին մոտ երկու ամիս ժամանակ է մնացել, բայց մենք դեռ «Ընտրական օրենսգիրք» չունենք: Ընտրությունը մարդու հիմնարար իրավունքն է, որից պետք է բոլորը հնարավորություն ունենան լիարժեք օգտվել: Սա է խնդիրը»,- ասաց Ա. Ղազարյանը:
Նրա կարծիքով, ամեն դեպքում պետք է ամեն ինչ անել, որպեսզի ընտրողի իրավունքը չզոհաբերվի հանուն քաղաքական գործընթացների իրագործման, ինչով որ ամենաշատն են մտահոգված եվրոպական կառույցները: Ա. Ղազարյանըկարևորեց նաև ընտրություններից հետո տեղի ունեցող գործընթացները՝ բողոքարկումներ և այլն, որոնք նույնպես կարող են ստվեր նետել անգամ ամենափայլուն գնահատված ընտրությունների վրա: Դրա առիթը չստեղծելու համար, պետք է արագ գործել և հաշվի առնել բոլոր կողմերի իրավունքները, համոզված է մասնագետը:
