ՊԵԿ-ում մեկնարկել են կոռուպցիոն ռիսկերը նվազեցնող նախաձեռնություններ

Պետական եկամուտների կոմիտեն կատարելագործում է հարկ վճարողների հետ փոխհարաբերությունների իրավական հարթակը։ Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ ՊԵԿ տեղեկատվության և հասարակայնության հետ կապերի բաժնից, հուլիսի 1-ից ուժի մեջ մտած փոփոխություններով՝ հարկ վճարողներին պարտադիր ծանուցման ենթակա փաստաթղթերն արդեն ուղարկվում են էլեկտրոնային եղանակով։ «Այդ նպատակով տնտեսվարողները հարկային մարմին պետք է ներկայացնեն իրենց էլեկտրոնային փոստի հասցեն»,-հայտնել է ՊԵԿ իրավաբանական վարչության պետ Արման Մնացականյանը: Գանձման և արգելադրման վարույթների վերաբերյալ ծանուցումները հարկ վճարողներն ստանում են ոչ թե առձեռն կամ փոստի միջոցով, այլ իրենց տրամադրած էլեկտրոնային փոստի հասցեներով, իսկ դրանց բացակայության դեպքում՝ www.azdarar.amկայքի միջոցով: 

Իրավաբանական վարչության պետը տեղեկացրել է, որ առաջիկայում գործարկվելու է «Իրավական վարույթների վարման» էլեկտրոնային ենթահամակարգը՝ բացառելով մարդկային գործոնը հարկ վճարողների էլեկտրոնային ծանուցման գործընթացում․ «Արդյունքում կբարձրանա հարկային վարչարարության արդյունավետությունը, կկատարելագործվի ստվերային տնտեսության դեմ պայքարի գործիքակազմը և բիզնես-հարկային մարմին փոխհարաբերություններում կբացառվեն սուբյեկտիվիզմն ու կոռուպցիոն ռիսկերը»:

Նոր կանոնակարգումներ են նախատեսվել նաև ստուգման և վարչական այլ ակտերի հիմքով հարկային պարտավորությունների կատարման և գանձման պարագայում: Հարկ վճարողների պարտավորությունների գանձման աշխատանքները կատարվելու են նշված ակտերն անբողոքարկելի դառնալու օրվան հաջորդող 10-օրյա ժամկետի ավարտից հետո: «Նպատակն է բացառել վարչական նոր վարույթների հարուցումը, բավարարվել արդեն իսկ հարուցված վարչական վարույթների արդյունքներով և խուսափել հարկ վճարողների գործունեությանն անտեղի միջամտությունից»,-ընդգծել է Արման Մնացականյանը:

Այս տարվա հուլիսից հարկային մարմնի օպերատիվ-հետախուզական միջոցառումների արդյունքում օրենքով նախատեսված պատասխանատվության կիրառման և հարկային պարտավորությունների առաջադրման նպատակով վարչական վարույթը ՊԵԿ նախագահի հրամանով իրականացնում է իրավաբանական վարչությունը, այլ ոչ թե օպերատիվ-հետախուզական գործունեություն իրականացնող աշխատակիցները:

Մեկ այլ փոփոխությամբ 2018թ․ հունիսից Վարչական իրավախախտումների վերաբերյալ ՀՀ օրենսգրքով հարկային մարմնի քննությանը ենթակա գործերով մեկ տարվա ընթացքում տնտեսվարող սուբյեկտների կողմից առաջին անգամ վարչական իրավախախտում կատարելու պարագայում հարկային մարմինը կիրառում է տվյալ հոդվածի սանկցիայով նախատեսված նվազագույն տուգանքը՝ անկախ այն հանգամանքից՝ անձը ներկայացել է գործի քննությանը կամ պատասխանատվությունը մեղմացնող հանգամանքներ ներկայացրել է, թե՝ ոչ: «Այս մասին կոմիտեն իրազեկել է տնտեսվարող սուբյեկտներին՝ առաջարկելով վարչարարության նոր կարգից շեղումներ լինելու դեպքում շտապ տեղեկացնել ՊԵԿ իրավաբանական վարչությանը»,-հաղորդել է Արման Մնացականյանը՝ տեղեկացնելով, որ վարչական տուգանքների վճարումներն անհրաժեշտ է կատարել բացառապես անկանխիկ եղանակով՝ համապատասխան վճարային համակարգերի միջոցով:
