ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի պաշտպանները մանրակրկիտ ուսումնասիրել են ՀՀ ԱԱԾ տնօրենի և ՀՀ ՀՔԾ պետի հեռախոսային խոսակցությունների ձայնագրությունը:
Ռոբերտ Քոչարյանի պաշտպան Հայկ Ալումյանը նշեց, թե կատարված ուսումնասիրությունները այժմ հիմք են տալիս պնդելու, որ քրեական գործի քննության, ներառյալ՝ Ռոբերտ Քոչարյանի կալանավորման ընթացքում թույլ են տրվել նրա իրավունքների և հիմնարար ազատությունների կոպիտ խախտումներ:
«Ռոբերտ Քոչարյանի պաշտպանները դիմում են բոլոր պատկան մարմիններին՝ սույն հայտարարության մեջ մատնանշված փաստերին համարժեք իրավական գնահատականներ տալու և հետագայում նմանօրինակ իրավիճակները բացառելու կոչով»,- ասաց Ալումյանը:
Սեպտեմբերի 11-ին տեղեկացվել էր, որ էլեկտրոնային մամուլում տվյալներ են հրապարակվել ՀՀ ԱԱԾ տնօրենի և ՀՀ ՀՔԾ պետի հեռախոսային խոսակցությունը գաղտնալսվելու մասին, որում հղում էր կատարվել «youtube.com» կայքում տեղադրված ձայնագրությանը: Նկատի առնելով, որ վերոնշյալում առերևույթ առկա է անձի հեռախոսային խոսակցությունների գաղտնիությունը խախտելու, առանձնակի արժեք ունեցող տեղեկատվություն ստանալու նպատակով համակարգչային կապի միջոցների օգտագործմամբ հաղորդվող տեղեկատվությունը որսալու հանցավոր արարքների հատկանիշներ՝ ՀՀ գլխավոր դատախազության հատկապես կարևոր գործերի քննության նկատմամբ հսկողության վարչությունում հարուցվել է քրեական գործ՝ ՀՀ քրեական օրենսգրքի 146-րդ հոդվածի 1-ին մասի և 254-րդ հոդվածի 3-րդ մասի 4-րդ կետի հատկանիշներով:
Նկատի ունենալով նշված քրեական գործի նյութերում առկա փաստական տվյալները, և այն հանգամանքը, որ զանգվածային լրատվության միջոցների հրապարակումների բովանդակությունը պարունակում է պաշտոնական լիազորությունների անցման հանցագործության առերևույթ առկայությունը մատնանշող տվյալներ՝ ՀՀ գլխավոր դատախազությունում հարուցվել է ևս մեկ քրեական գործ՝ ՀՀ քրեական օրենսգրքի 309-րդ հոդվածի 1-ին մասով:
