Երևանի ընդհանուր իրավասության դատարանի դատավոր Մկրտչյանը բավարարել է լեյտենանտ Արամ Աղայանին վաղաժամ ազատ արձակելու մասին պահանջը:
Այս մասին Tert.am-ի հետ զրույցում ասաց Արամ Աղայանի պաշտպան Արայիկ Պապիկյանը:

«Քրեակատարողական հիմնարկը դրական եզրակացություն էր տվել դատապարտյալի վարքի վերաբերյալ, դատախազությունը չառարկեց միջնորդությանը, իսկ դատարանը բավարարեց այն: Դատարանն Արամ Աղայանին վաղաժամկետ ազատեց պատժի հետագա կրումից»,-ասաց Պապիկյանը:

Պաշտպանը նաև հայտնեց, որ սույն գործով Մարդու իրավունքների եվրոպական դատարան բողոք է ներկայացված. «Մենք գտնում ենք, որ արդար դատաքննության իրավունքի խախտում է տեղի ունեցել, երեք հիմքով գանգատ է ներկայացված»:
Նշենք, որ Արամ Աղայանը մեղավոր էր ճանաչվել ՀՀ ՔՕ-ի 3581 հոդվածի հատկանիշներով՝ ստորադասի նկատմամբ բռնի գործողություններ կատարելը կամ դրանք կատարելու սպառնալիքը:

 
Հարցին, թե դեռ որքան պատիժ ուներ կրելու Արամ Աղայանը, Արայիկ Պապիկյանն ասաց, որ եթե դատարանը չբավարարեր միջնորդությունը, ապա ևս 2 տարի ու 6 ամիս Աղայանը պետք է մնար անազատության մեջ. «Մինչ այդ նա դատապարտված է եղել ևս մեկ գործով, որի պատիժը պայմանականորեն չի կիրառվել, սահմանված է եղել փորձաշրջան, որի ընթացքում տեղի է ունեցել այս միջադեպը: Եվ այս գործով 2,6 ամիս ազատազրկմանը գումարվել է նաև նախորդ ազատազրկումը, և միասնական պատիժ է սահմանվել 5 տարի 3 ամիս ժամանակահատվածը, որից 2 տարի 6 ամիս պատժաչափն Արամ Աղայանը պետք է կրեր»:

Նշենք, որ գործով տուժող ճանաչված Ռուդիկ Գրիգորյանը հայտնել էր, որ Աղայանն իրեն չի հարվածել: Գործով տուժողը դատաքննության ժամանակ հայտնել է, որ Աղայանը փորձել է արթնացնել իրեն, սակայն ինքը չի արթնացել, առաջ է եկել և իր թևի ու Աղայանի ձեռքի միջև եղել է բախում:

Հիշեցնենք, որ Արամ Աղայանը դատապարտվել է 2 տարի 6 ամսվա ազատազրկման զինվոր Ռուդիկ Գրիգորյանին առողջության թեթև վնասի հատկանիշներ չպարունակող մարմնական վնասվածք պատճառելու համար:
