Tert.am-ը գրում է.

ՀՀ երկրորդ նախագահ, «Մարտի 1-ի» գործով մեղադրյալ Ռոբերտ Քոչարյանի պաշտպանները վճռաբեկ բողոք են ներկայացրել: Այս մասին Tert.am-ի հետ զրույցում ասաց Ռոբերտ Քոչարյանի պաշտպաններից Հայկ Ալումյանը:

«Առնվազն երկու հիմք կա Վճռաբեկ դատարան դիմելու համար, որոնք առավել կարևոր են, սակայն վճռաբեկ բողոք ներկայացնելու այլ հիմքեր ևս կան: Նախաքննության գաղտնիությունից ելնելով՝ հայտնեմ միայն հիմքերից մեկը, համաձայն որի՝ «Մարտի 1»-ի գործը քննող Հատուկ քննչական ծառայությունը Ռոբերտ Քոչարյանի՝ արտակարգ դրություն հաստատելու մասին հրամանագիրը որակել է հակաօրինական: Վճռաբեկ դատարանը պետք է անդրադառնա այդ փաստին, որովհետև նման պնդում անելու իրավունք ունի Սահմանադրական դատարանը»,- ասաց Ալումյանը:

Պաշտպանը հայտնեց, որ այլ հիմքեր ևս կան, որոնց Վերաքննիչ դատարանը չի անդրադարձել:

Նշենք, որ Ռոբերտ Քոչարյանին անձեռնմխելի ճանաչելու վերաբերյալ Վերաքննիչ դատարանի որոշման դեմ վճռաբեկ բողոք է ներկայացրել նաև ՀՀ գլխավոր դատախազությունը:

Հիշեցնենք, որ Ռոբերտ Քոչարյանը հուլիսի 26-ին Հատուկ քննչական ծառայություն էր ներկայացրել վկայի կարգավիճակով՝ հարցաքննության։ Նույն օրը Ռոբերտ Քոչարյանին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 300.1-ին հոդվածի 1-ին մասով այն բանի համար, որ նա այլ անձանց հետ նախնական համաձայնությամբ տապալել է Հայաստանի Հանրապետության սահմանադրական կարգը։

Առաջին ատյանի դատարանը Ռոբերտ Քոչարյանին կալանավորելու միջնորդությունը բավարարել էր, իսկ Վերաքննիչ դատարանը Քոչարյանին ճանաչել է անձեռնմխելի, ինչի արդյունքում նա ազատ է արձակվել կալանքից, խափանման միջոց չի ընտրվել:
