«ՋԼՋ Պրոյեկտ Քոմփանի»-ի բաժնետեր Նարեկ Սարգսյանի բնակության վայրից հայտնաբերվել են շուրջ 6 միլիոն 800 հազար դոլար գումարով ավանդի պայմանագրեր

«ՋԼՋ Պրոյեկտ Քոմփանի» ՍՊԸ բաժնետեր Նարեկ Սարգսյանի բնակության վայրում հայտնաբերվել և առգրավվել են շուրջ 6 միլիոն 800 հազար ԱՄՆ դոլար գումարով ավանդի պայմանագրեր. Հայտարարագրման ենթակա գույքը թաքցնելու և ապօրինի հարստանալու դեպքերի առթիվ  նոր քրեական  գործ հարուցելու մասին որոշում է կայացվել: Այս մասին հայտնեցին ՀՀ Պետական եկամուտների կոմիտեի տեղեկատվության և հասարակայնության հետ կապերի բաժնից: 

Պետական եկամուտների կոմիտեի տարածած հայտարարության մեջ նշվում է, որ «ՋԼՋ Պրոյեկտ Քոմփանի» ՍՊ ընկերության վերաբերյալ ՊԵԿ քննչական վարչությունում ՀՀ քրեական օրենսգրքի 193-րդ  205-րդ հոդվածի 2-րդ մասի հատկանիշներով քննվող քրեական գործի նախաքննության ընթացքում պետական բյուջե է վերականգնվել  800 միլիոն ՀՀ դրամ:

Նախաքննության անհրաժեշտությամբ պայմանավորված՝ քրեական գործով խուզարկություն է կատարվել «ՋԼՋ Պրոյեկտ Քոմփանի» ՍՊԸ բաժնետեր Նարեկ Սարգսյանի բնակության վայրում, որի ընթացքում հայտնաբերվել և առգրավվել են  նրա, իր հետ համատեղ բնակվող  հոր՝ Լյովա Ազատի Սարգսյանի և քրոջ՝ Անի Լյովայի Սարգսյանի անվամբ 2017թ. 2-րդ կիսամյակի ընթացքում  որպես ավանդ ՀՀ-ում գործող բանկերից մեկում ներդրված շուրջ 6 միլիոն 800 հազար ԱՄՆ դոլար գումարով ավանդի պայմանագրեր:

Նախաքննության ընթացքում պարզվել է նաև, որ Նարեկ Լյովայի Սարգսյանի հայրը` Լյովա Ազատի Սարգսյանը, 2017թ-ի ընթացքում հանդիսացել է ՀՀ հատուկ հանձնարարություններով դեսպան և «Հանրային ծառայությունների մասին» ՀՀ օրենքով սահմանված կարգով հանդիսացել է հայտարարատու պաշտոնատար անձ:

Լյովա Ազատի Սարգսյանը և վերջինիս դուստր՝ Անի Ազատի Սարգսյանը, «Հանրային ծառայությունների մասին» ՀՀ օրենքի համաձայն, 2017թ. հաշվետու ժամանակաշրջանի համար հայտարարատու պաշտոնատար անձի համար սահմանված դեպքերում և կարգով Բարձրաստիճան պաշտոնատար անձանց էթիկայի հանձնաժողով են ներկայացրել  իրենց գույքի և եկամուտների հայտարարագրեր, որտեղ չեն հայտարարագրել իրենց կողմից որպես ավանդ ներդրված գումարները: Արդյունքում՝ ՀՀ օրենքով սահմանված հայտարարագրերում հայտարարագրման ենթակա տվյալները թաքցրել են, ինչը հանգեցրել է Լյովա Սարգսյանի և Անի Սարգսյանի  մասով առանձնապես խոշոր չափերով գույքի չհայտարարագրմանը, ինչպես նաև հաշվետու ժամանակահատվածում նրանց գույքերի ավելացումն էականորեն գերազանցել է նրանց օրինական եկամուտները, ինչը ողջամտորեն չի հիմնավորվում հայտարարագրերով, այսինքն` վերջիններս ապօրինի հարստացել են:

Բացի այդ, Նարեկ Սարգսյանը նույնպես նույն օրենքով սահմանված կարգով հայտարարատու պաշտոնատար անձի համար սահմանված դեպքերում և կարգով պարտավոր է եղել Բարձրաստիճան պաշտոնատար անձանց էթիկայի հանձնաժողով ներկայացնել իր գույքի և եկամուտների հայտարարագիր, որը սակայն չի կատարել: 2017թ. հաշվետու ժամանակահատվածում նրա գույքի ավելացումն էականորեն գերազանցել է նրա օրինական եկամուտները, ինչը ողջամտորեն չի հիմնավորվում հայտարարագրերով, այսինքն` վերջինս նույնպես ապօրինի հարստացել է:

ՊԵԿ քննչական վարչությունում քննվող քրեական գործի նյութերով որոշում է կայացվել ՀՀ քրեական օրենսգրքի 314.3-րդ հոդվածի 2-րդ մասով և 310.1-ին հոդվածի 1-ին հատկանիշներով  նոր քրեական  գործ հարուցելու մասին:

Ծանուցում. ՀՀ Սահմանդրության 21-րդ հոդվածի համաձայն` հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ օրենքով սահմանված կարգով՝ դատարանի՝ օրինական ուժի մեջ մտած դատավճռով:
