Արտակ Զեյնալյանը վստահեցնում է՝ Հայաստանում դատարաններն ազատ են, արտոնյալներ չեն լինելու

ՀՀ արդարադատության նախարար Արտակ Զեյնալյանը հունիսի 26-ին մասնակցել է «Վարչական արդարադատության ձևավորումն ու զարգացումը Հայաստանի Հանրապետությունում» թեմայով միջոցառմանը: Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ արդարադատության տեղեկատվության և հասարակայնության հետ կապերի վարչությունից, հանդիպումն իրականացվել է GIZ «Հարավային Կովկասում եվրոպական չափորոշիչներին իրավական համապատասխանեցում» ծրագրի շրջանակում՝ ՀՀ վճռաբեկ դատարանի հետ համատեղ:
Միջոցառմանը մասնակցել են նաև ՀՀ մարդու իրավունքների պաշտպան Արման Թաթոյանը, ՀՀ բարձրագույն դատական խորհրդի նախագահ Գագիկ Հարությունյանը, ՀՀ արդարադատության նախարարի առաջին տեղակալ Արթուր Հովհաննիսյանը, ՀՀ վճռաբեկ դատարանի նախագահի պաշտոնակատար Երվանդ Խունդկարյանը, Հայաստանում Գերմանիայի Դաշնության արտակարգ և լիազոր դեսպան դեսպան Բերնհարդ Մաթիաս Քիսլերը, դատավորներ, գերմանացի փորձագետներ, այլք:
Նախարար Զեյնալյանը ողջունել է համաժողովի մասնակիցներին և շնորհավորել Վարչական դատարանի հիմնադրման տասնամյակի կապակցությամբ:
Նախարարի խոսքով՝ Հայաստանի կառավարությունն այսօր շատ բարձր ժողովրդականություն է վայելում. դա պետք է վերակիչ լինի նաև դատական համակարգի համար: «Հայաստանում Սահամադրությամբ, ինչպես նաև միջազգայնորեն ստանձնած պարտավորություններով գործում է իրավունքի գերակայության սկզբունքը: Հաճախ իրավական ձևակերպումները հակասության մեջ են մտնում Սահամանդրության, միջազգային պայմանագրերի, Եվրոպական դատարանի վճիռների հետ: Եվ մենք ունենք Վարչական դատարանի բազմաթիվ դատական ակտեր, որտեղ այդ հակասությունը արձանագրված է, և ուղղակիորեն կիրառված է ավելի բարձր իրավաբանական ուժ ունեցող իրավական ակտերը: Այդպիսի դատական ակտերը հպարտության առիթ են դառնում միջազգային ասպարեզներում: Լավ կլինի, որպեսզի դա լինի օրինաչափություն և ոչ թե բացառություն»,- նշել է Արտակ Զեյնալյանը:
Նախարարն անդրադարձել է նաև այն երևույթին, որ եղել են պետական մարմիններ, որոնք վարչական դատարանում չեն պարտվել կամ դրանց պարտությունն այնքան հազվադեպ է եղել, որ ուղղակի չի նկատվել: «Այդպիսի մարմիններ Հայաստանում չպետք է լինեն՝ անկախ այդ մարմնի անվան հնչեղությունից: Հայաստանում արտոնյալներ չպետք է լինեն: Դատարաններն ազատ են. ոչ միայն մենք չենք այսպես ասած «զանգելու» դատավորներին, այլ նաև թույլ չենք տալու, որպեսզի որևէ մեկը «զանգահարի»»,- ասել է նախարար Զեյնալյանը և կոչ արել դատավորներին արդարադատությունն իրականացնել գիտելիքի հիման վրա, խղճով և Հայաստանի Հանրապետության անունից:
