ՄԻՊ-ը սոցիալապես անապահով ընտանիքի սովորողների դասագրքերն անվճար տրամադրելու հարցը քննարկել է ԿԳ նախարարի հետ

Սահմանադրական դատարանը Մարդու իրավունքների պաշտպանի դիմումի հիման վրա պետական հանրակրթական դպրոցների դասագրքերի համար վճարվող գումարների առնչությամբ ներկայացրել է պետությանն ուղղված կարևոր դիրքորոշումներ: Այս մասին տեղեկացրին Մարդու իրավունքների պաշտպանի աշխատակազմի հանրային կապերի բաժնից:

Մասնավորապես, դատարանը նշել է, որ պետությունը պարտավոր է երաշխավորել սոցիալապես անապահով ընտանիքների սովորողների համար դասագրքերի հասանելիությունն ապահովող որոշակի, թափանցիկ և հավասարության վրա հիմնված ընթացակարգեր: Դատարանը նշել է նաև, որ սոցիալապես անապահով ընտանիքի սովորողներին դասագրքերի անվճար հասանելիությունն ապահովելու կարգը պետք է ամրագրվի օրենքով և դրա հիման վրա  ընդունված ենթաօրենսդրական նորմատիվ իրավական ակտերով:

Հաշվի առնելով Սահմանադրական դատարանի որոշումը՝ ՀՀ մարդու իրավունքների պաշտպան Արման Թաթոյանը հարցը քննարկել է ՀՀ կրթության և գիտության նախարար Արայիկ Հարությունյանի հետ սոցիալապես անապահով ընտանիքի սովորողների դասագրքերն անվճար տրամադրելու կարգը սահմանելու համար:

Հիշեցնենք, որ ամիսներ առաջ «Դիսըբիլիթի ինֆո» տեղեկատվական հասարակական կազմակերպությունից, քաղաքացիներից ստացած բողոքների հիման վրա Պաշտպանը դիմել էր Սահմանադրական դատարան դասագրքերի դիմաց գանձվող վճարների սահմանադրականության հարցով: Որպես հիմնավորում նշվել էր նաև այն, որ օրենքով կամ նորմատիվ այլ իրավական ակտով որևէ տարբերակված մոտեցում չի նախատեսվում խոցելի խմբերին դասագրքերի վճարներից ազատելու համար՝ այդ գործընթացը թողնելով ուսումնական հաստատության մանկավարժական և ծնողական խորհուրդների որոշմանը:

Խնդիրն այն է, որ տվյալ դեպքում բացակայում է միասնական կարգավորումը, ինչը հանգեցնում է խտրական վերաբերմունքի: Ավելին, ամոթի և իրենց երեխաներին հնարավոր խարանից զերծ պահելու պատճառով որոշ ծնողներ առհասարակ չեն բարձրաձայնում իրենց կողմից այդ վճարների տրամադրման բարդությունները:
