Մասիսի քաղաքապետ Դավիթ Համբարձումյանը դատական կարգով կարող է բողոքարկել իր լիազորությունների դադարեցման վերաբերյալ նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազի որոշումը, եթե համաձայն չէ տվյալ որոշմանը:
Այս մասին «Արմենպրես»-ի հարցմանն ի պատասխան նշեցին ՀՀ գլխավոր դատախազության հանրային կապերի բաժնից՝ անդրադառնալով Մասիսի քաղաքապետի հայտարարությանն այն մասին, որ պաշտոնավարությունը ժամանակավորապես դադարեցնելու մասին որոշումը կատարելու որևէ օրենսդրական նորմ և ընթացակարգ չի գործում:
«Եթե համաձայն չէ դատախազի այդ որոշմանը, կարող է բողոքարկել դատական կարգով: Դատախազի որոշման մասին տեղեկացվել է ՏԻՄ-երի հարցով հսկողական գործառույթներով օժտված տարածքային կառավարման և զարգացման նախարարությանը, որ անհրաժեշտության դեպքում գործադրի միջոցներ՝ այդ որոշման իրացումն ապահովելու համար»,- ասացին ՀՀ դատախազության հանրային կապերի բաժնից:
Ավելի վաղ Մասիսի քաղաքապետ Դավիթ Համբարձումյանը հայտարարություն էր տարածել, նշելով, որ տեղական ինքնակառավարման ոլորտը կարգավորող օրենսդրությունը չի նախատեսում «համայնքի ղեկավարի պաշտոնավարության ժամանակավոր դադարեցման» ինստիտուտ:
«Ելնելով վերոգրյալից՝ պարզ է դառնում, որ պաշտոնավարությունը ժամանակավոր դադարեցնելու մասին որոշումը կատարելու որեւէ օրենսդրական նորմ եւ ընթացակարգ չի գործում:
Հետեւաբար՝ իմ կողմից ինքնակամ, առանց որեւէ իրավական ակտ կայացնելու պարտականությունների կատարման ժամանակավոր դադարեցումը կհանգեցնի Մասիս քաղաքում տեղական ինքնակառավարման բացակայությանը եւ իրավաբանական քաոսի՝ որեւէ պետական մարմին Հայաստանում նման դեպքում լիազորված չէ նշանակելու քաղաքապետին փոխարինող անձ»,- ասել էր նա:
Հունիսի 5-ին քրեական գործի նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազը որոշում էր կայացրել դադարեցնել Մասիսի քաղաքապետ Դավիթ Համբարձումյանի և նրա տեղակալ Կարեն Օհանյանի լիազորությունները՝ գտնելով, որ բավարար հիմքեր կան ենթադրելու, որ պաշտոնում մնալով՝ նրանք կխոչընդոտեն մինչդատական վարույթում գործի քննությանը:
