Դատարանը մերժեց Խաչատուր Գիշչյանի կալանքը փոխելու վերաբերյալ միջնորդությունը. անցկացվելու է դատաբժշկական փորձաքննություն

Երևանի ընդհանուր իրավասության դատարանի Էրեբունի նստավայրում մայիսի 24-ի դատական նիստի ընթացքում քննվում էր  ՊՊԾ գնդի գրավման գործով մեղադրվող  Խաչատուր  Գիշչյանի պաշտպան Մարինե Ֆարմանյանի միջնորդությունը` իր պաշտպանյալի նկատմամբ կալանքը որպես խափանման միջոց վերացնելու կամ փոխարինելու վերաբերյալ: 

Նախագահող դատավոր Արտուշ Գաբրիելյանը հայտնեց, որ դատարանը որոշում է կայացրել մերժել միջնորդությունը:

 

Գիշչյանի պաշտպան Մարինե Ֆարմանյանը միջնորդություն ներկայացրեց իր պաշտպանյալի նկատմամբ դատաբժշկական փորձաքննություն նշանակելու մասին: Դատարանը որոշեց Խաչատուր Գիշչյանի նկատմամբ նշանակել դատաբժշկական փորձաքննություն, որի կատարումը հանձնարարվել է ՀՀ փորձաքննությունների ազգային բյուրո ՊՈԱԿ-ին:

 

Դատավոր Արտուշ Գաբրիելյանը նշեց, որ փորձագետին կառաջադրվեն հետևյալ հարցերը.  ինչ հիվանդություններով է տառապում Խաչատուր Գիշչյանն, եթե այդպիսիք առկա են, արդյոք վտանգավոր են նրա կյանքի և առողջության համար, որքանով է անդրադառնում շարունակական կալանավորումը այդ հիվանդությունների զարգացման վրա, ախտորոշված հիվանդությունները որքանով են համադրելի կալանավորման հետ , արդյոք առկա հիվանդությունները ներառված են ՀՀ կառավարության 2006 թվականի մայիսի 26-ի որոշմանը սահմանված պատիժը կրելու խոչընդոտող ծանր հիվանդությունների շարքին:

 

Խաչատուր  Գիշչյանը մեղադրվում է Քրեական օրենսգրքի 38-219 3-րդ մասի 1-ին կետի հատկանիշով:
